Any kind of gun that shoots out any kind of projectile is legally not classified as a toy and why they are exempt from having the orange tip signifying a toy gun. BB guns can kill or seriously injure someone if they are hit in the right place especially at close range. They are NOT toys. Toys do not shoot projectiles that can seriously injure or kill. Period.
