Trump Administration Eyes Defining Transgender Out of Existence

WASHINGTON — The Trump administration is considering narrowly defining gender as a biological, immutable condition determined by genitalia at birth, the most drastic move yet in a governmentwide effort to roll back recognition and protections of transgender people under federal civil rights law.

A series of decisions by the Obama administration loosened the legal concept of sex in federal programs, including in education and health care, recognizing sex largely as an individual’s choice — and prompting fights over bathrooms, dormitories, single-sex programs and other arenas where gender was once seen as a simple concept. Conservatives, especially evangelical Christians, were incensed.

Now the Department of Health and Human Services is spearheading an effort to establish a legal definition of sex under Title IX, the federal civil rights law that bans gender discrimination in education programs that receive government financial assistance, according to a memo obtained by The New York Times.

This Woman Claims A Pharmacist Denied Her Miscarriage Medication Because He Said He “Was A Good Catholic Man”
A spokesperson for Meijer told BuzzFeed News the pharmacist in question is no longer with the company. However, they did not respond to inquiries about whether he was reprimanded for the alleged incident.


Rachel Peterson, a 35-year-old resident of Ionia, Michigan, filed an official complaint with the American Civil Liberties Union (ACLU) on Wednesday against a Meijer pharmacy in Petoskey, Michigan, claiming a pharmacist who was employed by the company at the time had refused to fill a prescription she needed to help complete a miscarriage. He allegedly cited his personal religious beliefs — and also refused to transfer the prescription elsewhere.

Peterson told BuzzFeed News the incident occurred in July. A few days earlier, she received devastating news that she had a pregnancy loss due to miscarriage, and that the doctor gave her the option to “let things progress naturally,” she said.

“They recommended I take the medication prescribed to me ... so I didn’t have to go through a more invasive procedure,” said Peterson. Her OB-GYN prescribed Cytotec, a medicine that helps to induce contractions and complete a miscarriage.


According to Peterson, when she called a local Meijer pharmacy on July 1, she was told her prescription would be ready for pickup within the hour. However, when she and her husband were heading out to pick it up, she received a call from a pharmacist at the location who apparently told her he could not fulfill the order because he was “a good Catholic man.”

“He said he could not in good conscious give this medicine ‘[be]cause he was a good Catholic man,’” Peterson said the pharmacist told her over the phone. “I asked and I said, ‘are you serious right now?’ I could not believe this was happening.”

She said she then felt compelled to have to explain to the pharmacist that her “ultrasound did not have a heartbeat, and I needed the medicine to further the process along.” But the pharmacist would not budge, nor would he transfer her prescription to another location. Fortunately, she said she was able to call another local pharmacy, which was able to fairly quickly and efficiently prepare the medicine that she needed.

More than 4.3 million Americans have already cast their ballots in the midterm elections, and early signs point to a huge increase in turnout from the last midterm elections in 2014, when overall voter participation hit a 70-year low.

The robust turnout in the first days of early voting in some states dovetails with other indications that voter enthusiasm is higher this year than in previous years. More voters showed up to cast ballots in party primaries than in years past, and polls show more voters say they are enthusiastic about or closely following news about the election than in prior contests.

“All signs point to a higher turnout election,” said Michael McDonald, a political scientist at the University of Florida who closely tracks early vote tallies. “Where we can make comparisons, so far the numbers are up from 2014. Which is not a surprise because 2014 was an exceptionally low turnout election.”


Nearly 26 million ballots have been requested or mailed to voters around the country, according to McDonald’s tally. That’s more than the approximately 25 million voters who cast a ballot early in the 2014 midterms, either by mail or in person. Millions more will vote in person when early voting locations open in their areas.

Access to the ballot box in November will be more difficult for some people in Dodge City, where Hispanics now make up 60 percent of its population and have remade an iconic Wild West town that once was the destination of cowboys and buffalo hunters who frequented the Long Branch Saloon.

At a time when many rural towns are slowly dying, the arrival of two massive meatpacking plants boosted Dodge City’s economy and transformed its demographics as immigrants from Mexico and other countries flooded in to fill those jobs.

But the city located 160 miles (257 kilometers) west of Wichita has only one polling site for its 27,000 residents. Since 2002, the lone site was at the civic center just blocks from the local country club — in the wealthy, white part of town. For this November’s election, local officials have moved it outside the city limits to a facility more than a mile from the nearest bus stop, citing road construction that blocked the previous site.

“It is shocking that we only have one polling place, but that is only kind of scratching the surface of the problem,” said Johnny Dunlap, chairman of the Ford County Democratic Party. “On top of that, not only is it irrational and ridiculous that we have only one polling place, but Dodge City is one of the few minority majority cities in the state.”
