In reply to the discussion: Tran Pacific Plan about to end almost all American Dreams [View all]octoberlib
(14,971 posts)16. Australia doesn't like the" intl corps having power over the laws of nations and states" clause
As a worst-case scenario, investorstate arbitration gives transnational corporations powers to trump the sovereign powers of nations and states and hold back policy developments such as those relating to sustainability and clean energy.[79] The Australian government and its negotiators have stated that they will not be agreeing to investor state dispute settlement provisions that give greater rights to foreign than domestic businesses in the TPP.

Australian Trade Minister Craig Emerson has argued that the Trans-Pacific Partnership is the first step toward a regional free trade agreement in the Asia-Pacific. But Australia, it appears, has refused to submit to the investor-state tribunal system in the negotiations over the agreement.
The leak of the investment chapter, and the San Diego talks this week, have sparked a wider debate about the agreement. Theres much concern in the Australian and the New Zealand parliaments about the anti-democratic nature of the treaty with its secrecy, absence of regulatory scrutiny, and lack of wider public participation. Theres also some anxiety about the impact of the agreement on investment, public health, industrial relations, the environment, and intellectual property.

The real question is why are we taking it? The second question is are we sure this is true?
