to me would be that she wouldn't have said, "I AM IN HERE". Second, a normal response when you hear noise is (1) Assume it is your spouse, (2) confirm they are not anywhere else, like in bed, (3) shift into high gear for an intruder.

On the other hand, it is pretty convenient for him that the bathroom has no burglar bars and the workmen left a ladder. Perhaps these things had crossed his mind earlier - for real - thinking about a burglar?

All that said....the witnesses hearing the fighting and screaming does him in.
