White supremacist leader killed in Sacramento County; individual detained in shooting

Police have detained a person of interest in connection with the murder of a prominent white supremacist leader at his home in Citrus Heights in Sacramento County, authorities said.

David Lynch, 40, was found shot to death in the bedroom of his home in the 5900 block of Merlindale Drive just before 4 a.m. Wednesday, according to police. He had been shot in the head and upper torso, authorities said.

Lt. Gary Hendricks, a Citrus Heights police spokesman, said the person of interest was taken into custody at gunpoint but “without incident” Wednesday afternoon at a gas station in Rancho Cordova. Authorities have not identified the individual, whom Hendricks said had not been charged.

They are the only ones I think who are violent enough to do this. I certainly don't think it was any liberal.

4. Jury nullification.
It's wrong when right-wingers do it, it's wrong for us.

I understand and share your disgust with the filth, but the killer needs to be fairly tried.



Besides, there's a good chance the perp is another skinhead, so we get rid of 2 for the price of 1.

9. Jury nullification is not always wrong
and one of the reasons juries were designed into our justice system was acknowledging that juries have a duty (not just a right) to nullify in SOME cases.

Consider a case where a legislature imposes a 10 yr sentence for shoplifting or for possession of a joint. Would jury nullification be wrong? No. It also would not be illegal (and there is extensive case law to back me up on this). Assuming this guy was murdered, I am not saying nullification is in order HERE. I am saying that jury nullification, like judicial review, seperation of powers, etc. is an important element of our legal system or even (if you must) our justice system

12. Think of it as a check and balance
I've been reading some legal blogs about jury nullification, and it seems pretty clear to me that the founders intended jurors to be a final check on govt. power. And that the concept that a jury might "go against' the law IF the law was profoundly unjust as a FEATURE not a bug of the jury system. Ultimately, like much of our system (see also RKBA or free speech) an IMMENSE amount of power, discretion and freedom is retained by the common man, in this case - a juror.

It's not just the legislative "elite", the elected few who have influence over the law. A jury has direct influence in that if they find a law profoundly unjust they have the final authority to nullify it.

That is an immense amount of power to rest with jurors.

14. I was about to say as well. Jury nullification is not "wrong".
It's sort of a guarantee. I agree it can be used wrongly, as it was used to refuse to convict Klansmen who murdered, but the power itself is not "wrong".
