Ex-Edwards Aide Ordered to Jail Over Sex Tape
North Carolina Judge Sends Andrew Young and Wife to Jail for Up to 75 Days for Contempt

Former John Edwards aide Andrew Young and his wife Cheri were ordered to spend up to 75 days in jail today over their handling of a purported sex tape allegedly made by the one-time presidential candidate and his mistress, according to ABC affiliate WTVD.

Superior Court Judge Abraham Penn Jones said that he held the Youngs in contempt because he believes they are withholding other items from the court, including, WTVD says, additional copies of the tape.

"There were things told to the court under oath, in affidavits, in testimony that turned out to be inaccurate. Right now, part of me says they didn't tell me the truth before in this court," Jones said, according to the Raleigh News and Observer.

The Youngs were not placed in custody immediately, according to WTVD in Raleigh, N.C.

29. I always got a creepy vibe from him but I could put my finger right on why.
John Edwards always closes his eyes when he starts to tell a big winded story. Joel Osteen does that crap as well which is fitting since that is what I associate that trait with the most; tent preachers. I don't know if it's a regional thing for sure but it seems to be something that I have as a New Yorker. When someone starts telling me a story and they close their eyes as they talk; my bullshit detector goes into over drive.

22. Not according to Andrew Young. Young stated that a wealthy
benefactor gave them money to use for whatever purpose they chose. If he's correct, it was not a direct campaign donation that kept Hunter afloat. Not trying to defend Edwards actions, but this may be a key point.

The current copyright laws are quite severe in dealing with distributing works without the rights to do so.

Possession of any or all copies of a work make no difference to US Copyright law. One cannot abandon ones copyrights and any transfer of rights must be in writing.

Apparently, the videotape was in a box of stuff supposedly meant to be thrown away but not removed to the curb for trash removal and was still in the house.

In some jurisdictions even the trash put outside for trash collection is still considered the property of the owner until it is picked up by the authorized trash collectors unless a sign is posted on it that says it's free to whoever wants it. Personally, I think that's a bit nuts, but there it is. Certainly, items in a receptical that is still inside the house would be the property of the owner. And in this case, from what I understand the tape wasn't even in an obvious trash receptical in the house but a box that could have been intended for the trash or for storage. As far as I'm aware, it's Young's claim that the box of stuff in which he found the tape was intended for the trash... which I think is a lie in an attempt to explain why he took/stole it.

Financial records (bills, receipts), bank and credit card statements, and passports stored in the same box -- does that look like trash to anyone here. My guess is that a series of previous informal requests for return of these items had been met with delay and denial by Young instead of producing the items.

Depending on the nature of Hunter's financial and other records, they could have been of great value to Young while writing his book, and to presecutors investigating possible wrong-doings, Not having access could have been a problem for Hunter in documenting or remembering details and dates of events and financial transactions, particularly when testifying before the Federal grand jury and Bush-holdover GOP prosecutor.

Young himself has stated that campaign funds were not used to support the affair, but were personal gifts to Edwards outside the campaign from a couple of wealth donors.

28. Weak enforcement many places. Can be prosecuted here in NC
Almost every country is signatory to the treaty and has enacted enabling legislation, but in many places enforcement is very weak. Even if you located the servers in a country that has not signed the treaty, you could still be prosecuted in the US. More likely if you were already subject to a restraining order.

Your argument is a bit like claiming you can not be prosecuted for bank robbery because you hid the money in a secret Swiss bank account.

The US Copyright Office covers these type issues at http://www.copyright.gov.

There have been several important cases in various countries which have tested jurisdictional issues involving copyright law, mostly involving movie and music industries, software, and personal privacy. While there are many areas that are not yet settled law, they are not germane in this instance.

Just because something is common practice (e.g. posting items on the net) does not make it legal. Digital media formats make it easy to copy and distribute works, without regard for having the legal rights to the item.

The Andrews have been all over the talk shows....wrote a book and making big money off the down fall of someone else. I detest that lying scumbag couple. Maybe jail will wipe the smirk off their faces...for at least 75 days.

12. Headline misleading, as the judge changed his mind
I know DU rules require that posts about news stories use the original title, but this one was very misleading. The Youngs were given until Friday to turn over all copies. What bothers me about this is the collective guilt assumption in ordering them both to jail, even if the judge later relented. Does a married couple become jointly guilty of any crime in which the court can't tell which partner is responsible? I doubt that Cheri deserved this kind of treatment. Things like "part of me says" and the judge "believes" seem awfully weak as a basis for such conclusions as he stated.
