Ed Schultz Just Said He Directly Asked Coleman What He Would Do

Three months ago, Coleman stated emphatically to Ed he would take it all the way to the Supreme Court.

I bet a request for a stay to keep Franken from being sworn in is being rushed to Samuel Alito as I type this.

12. If he is compromised by blackmail or bribery, there is it seems a good reason for a RICO
investigation. Maybe Reid should threaten the RNC with that.

The chances of Reid making a bold move in any direction unless engulfed by fire are pretty damn small. He's a go along to get along kinda guy. A 1990's Congress kinda guy.

3. Nope, he files directly with teh Justice that handles the Eight Circuit cases
That's Samuel Alito.

He could issue a stay, refer it to the court as a whole, and nothing be done on it until October, and no ruling until NEXT FUCKING YEAR!

Article I, Section 4 - Elections, Meetings

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Place of Chusing Senators.

Section 5 - Membership, Rules, Journals, Adjournment

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide

In my view, the Senate, not the Supreme Court, has the authority and responsibility to judge the election of Senator Franken.

11. I'm not sure that Alito would issue a stay.
And the reason is more due to politics than to legalities - the blowback from obstructing the seating of Franken is definitely building up for the GOP, and they're likely to say that they've had their fun, but it's time to move on.

Alito might yet issue a stay - he's enough of a right-wing asshole that such a move would not be beneath him, but at the same time, I'm getting the impression that he and the rest of the SCOTUS do not want to deal with another election clusterfuck like Bush v. Gore.

Also, it's sounding like Pawlenty doesn't want to torpedo his presidential hopes, so he's likely just sign the certificate.

My bet is that it's over. Coleman has ten days to file for an appeal, but absent of a stay that even Alito probably doesn't want to issue, Pawlenty's going to certify Franken and he'll be seated.
