3. Takes a Constitutional amendment.
Get the legislative branch and 38 states to agree, and it will happen.

"The President (sic) shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

5. How is "session" defined?
If Bush can go elastic on recess appointments, why can't Congress go elastic on "sessions"?

6. If they can they should stay in session the whole two years. They
would probably need a certain number of reps/sens there but with luck that could be done by those closest to DC could make short stops at the capital and also have a list of people who could be called in from farther out if needed.

This cannot go on. Every step we take ahead he moves another back.
