LOUISVILLE, Ky. — Lawyers for an ex-soldier charged in federal court with killing an Iraqi family have withdrawn a motion that questioned the potential jury pool.
Attorneys for Steven D. Green of Midland, Texas, argued in filings on Tuesday that the potential pool is lacking blacks. On Wednesday, they withdrew the motion. Attorneys for Green, who is white, did not return a call seeking comment Wednesday.
Green is to go on trial in Paducah on April 27 on murder and rape charges and could face the death penalty if convicted. Jury selection is scheduled to start Monday.
Prosecutors declined to comment on the motion.
http://www.business24-7.ae/articles/2009/3/pages/ussergeanttostandtrialiniraqmurdercase.aspx...In another case involving the rape and murder of a 14-year-old Iraqi girl and the killing of her father, mother and younger sister, four soldiers were convicted by a court martial and handed sentences of up to 110 years in prison.
The last defendant, Steven D. Green, is to be tried next month in a civilian court in Paducah, Kentucky and could face the death penalty if convicted.
If you don't know what this is about, here is wiki link.
http://en.wikipedia.org/wiki/Steven_Dale_GreenBasically, this guy was in trouble with the law at home and was given the option of military or jail. He chose military. While in Iraq, he stalked a 14 yr old, then, with buddies, raped her, murdered her mom, dad, little sister, then set her on fire to try and destroy the evidence. Later several USA military guys in the area were taken by Iraqis and killed, some said in retaliation.
He was honorably discharged back to the USA civilian world. Whomever discharged him knew he had serious mental health issues. When news of this atrocity hit the media, they called the 14 yr old Abeer "a woman", prompting much outrage since it seemed the crime was trying to be diminished.
The others involved in this were court martialed and have various sentences. Since Green is now a civilian, it is being tried in civilian court.
I am against the death penalty but this person needs to be incarcerated forever.
Looking over documents filed, he even wanted to go back to Iraq to interview people there. This was denied, saying it was meant only to slow down the trial. This was filed a couple months ago.
