Stevens allowed to vote next week

Sen. Ted Stevens (R-Alaska) will be allowed to vote in next week’s election despite being found guilty of committing seven felonies, an Alaskan agency ruled Wednesday evening.

In order to be disqualified from voting in Alaska, a citizen must have committed a felony involving “moral turpitude” and the guilty verdict must meet the legal definition of a conviction.

Stevens’s crime does amount to a felony of moral turpitude, but since the court case is not officially concluded, he has not technically been convicted, according to a memo from the Alaska Department of Law.

“Accordingly, we think that Sen. Stevens should not be barred from voting...until a final judgment and sentence has been entered by the federal court in the case,” Michael Barnhill, senior assistant attorney general for Labor and State Affairs told Gail Fenumiai, director of the Division of Elections, in a memo ...

9. he's not officially a felon until he's sentenced.
as noted below- that's how kenny-boy lay got out of it despite being convicted- he "died" before sentencing.

until sentencing, the case isn't concluded- and until then, he isn't officially "guilty" of anything.

5. Don't forget the case of Kenny Boy Lay
Because he croaked (maybe) before he was sentenced, his conviction was voided and his ill gotten gains were not seized. That was their story anyway.

So if Stevens goes tits up before he gets sentenced or his appeals run out, he's not a convicted felon.

Thats how it works for repubs at least.

My only point was until the jailhouse door clanks behind a repuke, he ain't a convicted felon.

But Bill Ayers who's never been convicted of jack shit, he's like public enema #1.

And although I don't care if Stevens votes, I don't want to see him win. And what I really don't want to see is the scenario where he wins then has to go to jail and can't serve so Palin appoints herself to his seat.

6. Good. The image of him voting has to be very bad PR
A criminal can vote if that criminal has political pull. All other felons are just peons who don't have that right.
