Prosecutor in Trial of 9/11 Conspirator Zacarias Moussaoui Informs Judges That He Viewed Two Videos of al-Qaida Suspects' Interrogations Two Months Ago That Government Told Court in 2003 It Didn't Have -- And CIA Chief Said Were Destroyed

A letter by a Virginia-based U.S. attorney to a federal appeals court appears to contradict CIA Director Michael Hayden's public statements on the destruction of hundreds of hours of video footage of "extreme" interrogations of suspected al-Qaida operatives by strongly indicating that at least two of the videos still exist.

Charles Rosenberg, the U.S. attorney for the Eastern District of Virginia, wrote that his office viewed two videotapes of CIA interrogations of al-Qaida suspects as recently as September 19 and October 18 of this year -- contrary to Hayden's statement that the tapes were destroyed in 2005.

In a letter made public Nov. 13, prosecutors in the Moussaoui case admitted to Brinkema that the CIA had wrongly assured her that no videotapes or audiotapes existed of interrogations of certain high-profile terrorism detainees. In fact, two such videotapes and one audio tape existed.

Moussaoui, who had pleaded guilty to terrorism charges, was sentenced to life in prison last year. Because Moussaoui admitted his guilt, it is unlikely that the disclosures of new evidence would result in his conviction being overturned.

Turley, al-Timimi’s defense lawyer, praised Brinkema for taking a skeptical view of the government’s assertions in addressing al-Timimi’s case.

"We believe a new trial is warranted," he said in a phone interview. "We are entirely confident that there are communications that were not turned over to the defense. These are very serious allegations."

6. It Would Strike Me as Odd Indeed, Ma'am

If all tapes of the interrogations were destroyed: they would be the primary source documents for the intelligence work derived from the information gained, or thought to be gained, by the torture, and as such would be very valuable resources for years. Doubtless some of what the people said was fabrication or even planned disinformation, and usually when people lie, there are 'tells' in their speech and manner. Once some of the leads had been run down, it would be possible to build up an impression of what other things said might well be false, and which could be true, even where it proved impossible to verify or disprove by independent investigation.

12. The videos still exist

I suspect in their entirety. 2 things tell me this:

1. This Admin keeps copies of everything for blackmail and general record keeping
2. This Admin never tells the whole truth about anything, when they aren't outright lying

The videos exist, and if anyone can get their hands on them, will have the most potent material imaginable to use against this Admin. These were things that were NEVER supposed to see the light of day, so it's likely this is Bushco with their hair down.
