Umatilla County loses dispute over on-call pay

The Oregon State Employment Relations Board sided with the local AFSCME union in a dispute with Umatilla County regarding on-call time and compensation for probation counselors in the juvenile department.

The dispute originally happened in summer 2007, when difficulties arose between the probation counselors and director of youth service, Charles Logan-Belford. The order said Logan-Belford threatened and carried out threats against probation counselors after they took part in union-protected actions.

Probation counselors supervise youths on probation by overseeing their court orders, meeting with parents and working with schools and assisting the youth's family. If a youth re-offends and police believe he or she needs to stay in the detention facility, the counselors make that determination.

On weekends, historically, the counselors would take on-call shifts to answer calls and make determinations about housing.

When the county and union ratified their contract in 2007, the county did not initially pay their for their on-call time. Upon finding out, counselors Josh Paulus and Digna Moreno raised concerns with union attorney Jason Weyand.

In July 2007 the employment board's order said Weyand said he had a conversation with Logan-Belford, telling him Weyand planned to file a grievance about the lack of on-call pay.
