Bring back court-packing!

Should we ever get back the Presidency and both houses of Congress, we will be stuck with a right-wing Supreme Court for a generation or more. I can't see how we can impeach any of the justices simply for ruling on something that helps the right. However, there is one thing that we can do: expand the size of the Supreme Court. Lets say that in five years from now we control both the White House and Congress. This will be the first time since the early 90's that we would have everything. Now, after eight years of Bush, the SCOTUS has gone from 6-3 in favor of Roe v. Wade, to 5-4 or 6-3 against. The SCOTUS overturns Roe v. Wade, provoking a backlash that elects Democrats. In the aftermath, we say what the Republicans have said about the court: activist judges have taken away the right to choose, therefore, we seek to correct the balance of the court and return it to a principled court. Lets say we expand the SCOTUS from nine judges to eleven or twelve. We could undo the damage that Bush has done within four to eight years.

Desperate times call for desperate measures. Honestly, if I were around when FDR proposed expanding the SCOTUS, I might have have been uneasy about supporting it (although since the SCOTUS was assaulting the New Deal I cannot sympathize with them), but in today's state, there is nothing else that we can do that will prevent the country from being forced againt its will ot lurch right.

4. I agree and have posted this suggestion. Be prepared for
some flack. FDR is the example they use, but the threat did the trick then. Congress has changed the size of the court six times in the past. It should be an odd number of justices to avoid ties.

After he pushing for expanding the court, the justices stopped trying to obstruct his programs. Interestingly enough, because he ended up being in office for so long, he managed to remake the court without changing its size. In today's age, we have term limits, so expanding the court is the only solution (unless we follow Pat Robertson's lead and pray for the deaths of Scalia, Roberts, Thomas, and Alito.)

9. I don't think that'll fly
As much as I agree with it. I can't see us having the opportunity to expand the court until AFTER Bush is out of office and we have a Democratic executive with Congress. I don't think that they will visit something that is nine or ten years old. I predict that Roe vs. Wade will be overturned around the end of the decade, and this will bolster support for expanding the courts.
