Corzine's right to name his successor upheld

Corzine, as NJ's new governor, will appoint Rep. Robert Menendez to replace him in the Senate until the conclusion of his term ...

A suit was brought challenging Corzine's right to make an appointment. The suit demanded that a special election be held.

A NJ Superior Court judge ruled today that Corzine did have the right to appoint his replacement. There will be no special election.

Superior Court Judge Linda Feinberg rejected the claim of attorneys Bruce Afran and Carl Mayer that state law mandates a special election to fill the U.S. Senate seat.

The judge said the law is "clear and unequivocal" in allowing the governor to appoint someone to fill a U.S. Senate vacancy until the next election.

The ruling clears the way for Rep. Robert Menendez (D-13th Dist.) to take over when Corzine becomes governor next week.
