Through two amendments to defense bills, it looks like Reid sponsored amendments will have fixed this by the end of September 2008 once the 2009 budget (Senate Res 70) passes. It is also a nice example of how things are introduced, pushed, reintroduced, broken into pieces etc to finally become law. First, there was an amendment that passed on the 1/28/2008 bill, but it speaks of TOTAL disability, which seems to not help any with less than 100% disability. SA 4162. Mr. REID submitted an amendment intended to be proposed by him to the concurrent resolution S. Con. Res. 70, setting forth the congressional budget for the United States Government for fiscal year 2009 and including the appropriate budgetary levels for fiscal years 2008 and 2010 through 2013; which was ordered to lie on the table; as follows:
At the appropriate place, insert the following:
SEC. __. DEFICIT-NEUTRAL RESERVE FUND FOR ACCELERATION OF PHASED-IN ELIGIBILITY FOR CONCURRENT RECEIPT OF BENEFITS.
The Chairman of the Senate Committee on the Budget may revise the allocations, aggregates, and other appropriate levels and limits in this resolution for a bill, joint resolution, amendment, motion, or conference report that provides for changing the date by which eligibility of members of the Armed Forces for concurrent receipt of retired pay and veterans' disability compensation under section 1414 of title 10, United States Code, is fully phased in from December 31, 2013, to September 30, 2008, by the amounts provided in that legislation for those purposes, provided that such legislation would not increase the deficit over either the period of the total of fiscal years 2008 through 2013 or the period of the total of fiscal years 2008 through 2018.

Retired Pay Restoration Act of 2007 - Allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability (currently, only a disability rated at 50 percent or more). States that, in the case of a qualified retiree receiving veterans' disability compensation for a disability rated as total by reason of unemployability, payment of military retired pay is subject to a phase-in of concurrent receipt of both only during the period beginning on January 1, 2004, and ending on December 31, 2007 (currently September 30, 2009).
