After talking to a decent lawyer, I've concluded a law suit for misrepresentation is not feasible. Assuming I won, I'd get only about half my money back...and it could take 2 years. I feel certain the insurance companies wouldn't settle -- they don't want to set precendent.
But after reaching a giving up point, it dawned on me that *maybe* the selling realtor that misrepresented the property would give up part of their 'take' in order to get the listing and to help "make it right." So I could recoup a little of the money I lost without the risk and trauma of a lawsuit.
So this morning I called 3 different realtors to interview. Including the realtor that had listed the place when I bought it.
Lo and behold, it turns out the original listing agent did not retire, as I had expected. Even better, I think he's a partner. He may be the one coming to the appointment on Wednesday.
If nothing else, I'm looking forward to his response when I confront him with the $40K lost he gave me.
