Publicly proclaiming they are gay used to mean automatic discharge for service members, but legal experts say the impending repeal of “don’t ask, don’t tell” likely means there will be no repercussions for those who marched.
That legislation has been headed toward repeal since a California federal judge deemed it unconstitutional in October; it was repealed by Congress in December. The parade took place the day after the latest decision by a federal appeals court to reinstate enforcement of the law.
Although “don’t ask, don’t tell” technically is still the law, Defense Department spokeswoman Eileen Lainez said just before the parade that the court’s reinstatement of the law did not change DoD’s current policy that discharges and investigations of gay service members remain suspended.
But legality wasn’t first on the minds of everyone marching.
