New York to Abu Gonzales, MCM, Bev Harris, Holt and Feinstein: FAWGETABOUTIT ! ! !
We don't need Holt; we don't need Feinstein; we don't need Bev Harris, or even Mark Crispin Miller! Know why??? BECAUSE WE WEREN'T EVEN FOOLED THE FIRST TIME!!!

And we CERTAINLY don't need no stinkin' Exit Polls to tell us who won our elections!


The following is an excerpt of a proposed "HAVA Extension Bill" adopted by the Bi-Partisan Election Commissioners Association of the State of New York. Pay particular attention to Section 3 (emphasis added; watch and learn):

AN ACT to amend chapter 181 of the laws of 2005 amending the election law and the state finance law relating to enacting the Election Reform and Modernization Act of 2005, in relation to voting machine and system implementation

Section 1. Section 11 of chapter 181 of the laws of 2005 amending the election law and the state finance law relating to enacting the Election Reform and Modernization Act of 2005, is amended to read as follows:

S 11. Help America Vote Act voting machine and system implementation. Effective the first federal election after March 1, 2008, each polling place shall be equipped with at least one voting machine or voting system which is equipped for individuals with disabilities and provides individuals with disabilities with the same opportunity for access and participation as other voters and which meets the requirements of section 7-202 of the election law and the federal Help America Vote Act.

Effective on the date of the first election for federal office after March 1, 2008, all lever machines in New York state shall be replaced by voting machines or voting systems which meet the requirements of section 7-202 of the election law, provided, however, that with respect to any board of elections which determines to retain lever machines on or after the effective date of this act and prior to the date of the first election for federal office after March 1, 2008, the provisions of this act which impose new standards for voting machines which were not required prior to the effective date of this act, including the amendments to section 7-202 of the election law made by section six of this act, shall not be applicable with respect to such lever machines during any period of time during which such lever machines are lawfully utilized.

Section 3. Notwithstanding the foregoing, in the event that the state board of elections has not certified more than one voting system as complying with the requirements of section 7-202 of the election law by December 31, 2007, the effective date of section 11 of chapter 181 of the laws of 2005 shall be December 31 of the year in which the state board of elections makes such certification.

Section 4. This act shall take effect immediately.:patriot:

2. WTF is this in English? It says that...
every election district has to have a new certified system next year unless they don't have one. And this isn't even a bill, just a proposal for one.

I know my county is kicking and screaming it doesn't have the bucks for new voting systems, as are many other NY counties.

4. Well Bill, I guess this will just have to remain our little secret.
Perhaps someone will come along and realize that NY State is not in compliance with HAVA.

On it's face, this would seem welcome news. But in fact, it requires that one drop the torches and pitchforks and think.

These are probably the same folk that visit NYC and take a stroll through Central Park at midnight.

Does that mean nothing to YOU, Wilms? I am willing to FIGHT FOR YOUR KIDS RIGHT to observe the counting? But you keep BULLSHITTING. I don't get it?

Was it in response to the State Legislature's lack of change to the law and is this the Commissioner's newest interpretation?

Looks like we could be using NYSBOE's "Plan B" for quite some time!

14. It's being proposed by the Commissioners.

And discussed by the State Board of Elections today at their meeting. But, it was discussed at the last meeting too, and they seemed to back it at that time and I believe had a role in drafting it.

And it looks pretty good to me!

The courts have incorrectly interpreted the 2005 law in my view, but this will seal the deal! Suffolk County may not have to appeal, but if they do, they could still win the right to keep their levers under the old law, and there are at least 2 other counties who would join them.
