URGENT, URGENT! Contact the Dems... before Kerry CAVES IN AGAIN!!!
Attention DUers -- this is absolutely URGENT! I am still on the ground in Atlanta... got this from an extremely good source, who I can't name on here:

1.) David Cobb and Michael Badnarik STILL have an ongoing suit in Toledo OH Federal Court, Cobb v. Blackwell, regarding the flawed recount they got in 2004. Kerry/Edwards campaign had filed papers in the case supporting the the Greens and Libertarians in the case.

2.) While obviously this suit isn't going to change the election results, the hope is that it might preserve any evidence that is still left, and most importantly, set a precedence in case law to help keep this from happening again in future recounts.

3.) Word is that that the Kerry/Edwards Campaign is preparing to withdraw from the Cobb v. Blackwell case, effective the end of this month! This would have a devastating effect on ANY chance the case might have of success, as per #2.

Now -- THIS IS URGENT -- Contact the Democratic Party and John Kerry and John Edwards; put pressure on and tell them DO NOT DROP OUT of Cobb v. Blackwell !!!! DON'T LET THEM DO THIS; don't let them cave in AGAIN.

Don't let Kerry/Edwards hand Blackwell ANOTHER free pass.

Time is short... Please blast this to everyone you know, please, and KEEP KICKED.

3. Though I agree we need to encourage the Kerry/Edwards
campaign to remain involved in the Cobb v. Blackwell case, they haven't given up, they are still parties in the Ohio Federal Court case that is still active.

They have been active in existing litigation.

47. Seeing this a Kerry thread
1) Kerry fought and voted against CAFTA, after trying hard in committtee to at least mitigate some of the worst affects of CAFTA - his amendment failed 10-10, but it would have helped with workers rights and the environment.
2) Kerry did "touch" the DSM - he has mentioned it in speaches and in a letter he got 8 other Senators to sign to demand part II of the WMD document in light of DSM.
3) He has called for Rove to be fired in a public news conference - with Hillary nodding her agreement.
4) Kerry has clearly made the decision that the way to go on election fraud is to make it an American issue and to fix it going forward. It is nonsense to say Kerry doesn't care - he really sincerely wanted to change things. He has a right to determine the way he thinks is most likely to succede. He has been arguing that people need to become active on this and fix many of the issues on a local level - which is the level that runs the election. He (with Boxer and Clinton) are the sponsors of legislation at the federal level.

In Ohio, the neutral bipartisan LWV has become involved. This is a good sign. The libertarians and Greens were acting in there own interest on this and have done a service to the country in making it more obvious that the Republicans were employing many dirty tricks to avoid a fair vote.

Notice the amount of coverage and dirision that is sent by the RW at Kerry whenever he speaks of voting issues. Although he has taken the high road, and is appealing for only the type of fair election that we all took for granted we had, thay act as though he has said something inappropriate. (The RW's biggest problem is that Kerry has the high ground on this and, even when very angry, Kerry speaks very reasonably.) There is no one with more moral right to discuss this than Gore or Kerry. Encouraging both to do so, in the way they choose, can only help . It really is an American, apple pie type issue, the way Kerry has positioned it.

17. Doubtless this will be based on the ridiculous DNC "report" on the Ohio
Election results which claimed on the basis of extremely questionable analysis of data provided by Blackwell that there was no evidence of widespread fraud in Ohio.

This is very, very bad. Pleas to them to stay in the fight will have to be associated with a rebuttal to the DNC "report."

If the rumor is true that Kerry/Edwards is considering pulling out of the Cobb/Badnarik suit in regards to the chaos that occured during the election in Ohio, I am speechless. I honestly don't know if I'd be able to justify bothering to vote again for a party that failed to represent us in Ohio to the extent that I felt they should of, this would honestly be the last straw.

He wasn't the original person I spoke to, but David confirms what was in my post.

He said to tell you, (quote) "Kerry didn't just concede, he capitulated!"

And he added if Kerry/Edwards withdraws from this suit it is just ANOTHER broken promise to count every vote and stand up for every voter.

(Me again talking...) The threat of them withdrawing is VERY real. They will probably do it as of August 30 if we don't take action and convince them not to do this. It appears that Kerry is already starting to "distance" himself from us wild-eyed glazed-looking conspiracy theorists, in preparation for his 2008 run.

Grrrrrr!

DAVID COBB stood up for us in Ohio and he will continue to do so.... PLEASE STAND UP FOR DAVID... Contact Kerry/Edwards and the Dems and tell them to DO THE RIGHT THING and see Cobb v. Blackwell through to the end!

I can't bring myself to write to the Repub-Lite DLC. I can still feel the wound of the knife in my back from Kerry's capitulation to the stolen election of '04. If Kerry folds AGAIN, it will be another turn of the knife. If Kerry thinks he has a snowball's chance in hell in '08 he's the wild-eyed lunatic CTer. If you can prove the fraud, please, do tell. Meanwhile back in reality, people concede if they can't immediately prove that they won. BTW, I *think* there was fraud. But I can't *prove* it. BIG difference.

Most candidates concede the night of the election. Paul Hackett did, despite a close 50-50 race. Did he "capitulate" too?

He conceded the next day which is the longest anyone's ever waited. Yeah, even Gore conceded that night, only to retract it later when it became apparent he may have won. No such evidence - and by EVIDENCE I mean something you can PROVE, not idle speculation - exists this year. But whatever :eyes:

us begging him not to concede! Really, we all know that he conceded too damn quick! The question is WHY!!!!!! We fought like hell for Kerry (just as we did for Gore)! Why did he concede so quickly????? We have been searching for an answer since the election! It made absolutely no damn sense! He knew that the election of 2000 was stolen by Bush and his cronies! So tell me why did he concede so damn quick!!!!! Tell me! I am more than disgusted by him ( I expected better from him than I received from Al Gore, who I was also disgusted by his concession!)

As you can tell, I am totally pissed by both of them!!!! So, give me an answer!

This supposed ignorance of votes goes over like a lead balloon! Remember 2000!Any politician in a race since 2000, has no credibility with me when they state that they could never believe that their vote would not be counted! I, on the other hand, believe that votes are only counted if they are Repub, since 2000!

Kerry doesn't need David to make him look bad... he did a pretty darn good job himself, starting about 2-3 AM on January 3, 2004.

But you come out here making serious allegations, asking for action with a non-disclosed "source" which turns out to be someone who would like to encourage all DEMS to abandon the party and join him.

Sorry, but until I see documentation, I won't believe a word of this.

Now, if you want to take that personally, I can't stop you. But, I would hope that a DEMOCRATIC activist would ask for more than the word of someone with a motive to turn you away from the Democratic Party.

As one who supported you in 2004 - for the first time in my life I made a contribution to a political party or campaign, that's how strongly I felt, and still feel, about your campaign, I am asking you, please, do not withdraw from the Cobb-Badnarik suit. Whatever your reasons for not pursuing the fraud investigation, and I can imagine some good ones, to keep faith with those who supported you, because of your integrity, at least allow others to seek and publicize the truth.

I think I know why you made your service a focal point of the campaign: duty compels those with integrity, even beyond personal interest or ambition. Please, if you want to heal this country, end the hatred that divides us, you must help the truth.

We will never get beyond "labels as epithets" which substitute for genuine debate, we will never be able to trust those on the other side again, to grant them the assumption of wanting a world at peace in which to raise their children, unless we help the American people, all of us, face the truth about our elections, our news and information, and some of our politicians.

You can reach across the aisle only after the cancer there has been removed.

Trust the people. When we learn that the election was stolen, our anger will be against those who betrayed and deceived us. But we will turn to each other, argue and quarrel over differences, yes, but put aside those differences for the larger American family. (As you said, remarking about who we were on September 11...) At that time, we will need a true uniter. But to trust him (you), we must see his - your - courage now, now as it was then.

Silence gives consent. Remain a party to the Cobb-Badnarik suit. Please.

so I'm reposting it here.

and clarification about what was going on.

Basically, the Kerry/Edwards campaign is no longer in existance period. All the bills have been paid and all the money has been dispersed. They can be involved as individuals but not as citizens. Therefore, if this were to go to court, they would have to provide evidence of the fraud AND they would have to provide evidence of harm. Those are two extremely HIGH hurdles and they can not be met at this time!

We KNOW there was fraud, but we have NOTHING other than stats and probability. And without that, they can't go to court.

Furthermore, they are trying to help us through their current jobs--Senator and Poverty commission (public speaker)--so this in itself eliminates the argument for "harm" because they are both still successful. Secondly, the actions they've taken STILL try to protect us. They have not rolled over and played dead.

BUT until a whistle-blower comes forward with proof, there is nothing to add to any lawsuit in Ohio.

One thing all of us Kerry supporters do know is from our knowledge on the BCCI and that is Kerry is not a quitter. So we can assume he played dead as the GD would like to keep doing, OR we can take our knowlege of Kerry as a prosecutor, kerry as the investigator of the Iran-Contra affair, and Kerry as the investigator into the terror (money laundering) of BCCI and presume that this man has simply gone undercover to get the information he needs.

Hope I make some sense."

82. Your argument abt harm is bogus. Just because they have jobs doesn't
mean that no harm was done. That's ridiculous. If you hit me with your car -- and I live through it with two broken legs -- that doesn't mean you didn't do any harm just because I am still alive.

And what is the difference between being involved as a "citizen" and as an "individual"? I think in the case of people eligible to run for president -- the two labels are synonymous. Sounds bogus to me as well. And just because the campaign has paid it's bills doesn't mean that it no longer exists for the purposes of a lawsuit. It just means it has paid it's bills.

And how do you know that all they have is stats and probability, furthermore what legal precedence is there that says statistics and probability are not substantial evidence to warrant a lawsuit. Plenty of suits every day are decided on probability -- DNA evidence is circumstantial evidence based on the probability that only one in X million people would have your identical DNA.

Sorry your post makes no sense whatsoever.

Just got back from a Nashville celebration of the 85th anniversary of Tennessee being the deciding state to approve women's suffrage. Great networking opportunity for our group. We handed out over 100 "Who did your voting machine vote for?" buttons, and had people tracking us down at the end of the evening asking for them.

Though I posted a link to this letter earlier, I thought I would just post it here to make it easier to read. I've heard from about a dozen other Tennesseans and friends as far away as Seattle who also wrote Kerry and Dean today. Hope you have (or will) too. Peace out.

Dear Senator Kerry,

During the 2004 campaign, I worked hard to get you elected and -- in so doing -- to help America awaken from the fascist nightmare that has captured our country and our psyche for the past six years. I believe that, for the second time in as many Presidential elections, the American people selected an intelligent, sensitive and seasoned Democrat to lead us and to represent our values to the rest of the world. And for the second time, the will of the American people was simply ignored.

In your case, I do not believe that it was even close. Once the American people saw what an empty and ignorant sock-puppet George W. Bush really was, they voted to oust him in no uncertain terms from the highest office in our land. But today, there you sit quietly in your Senatorial office as Bush takes another paid holiday and arrogantly refuses to speak with Cindy Sheehan, the mother of one more American youngster who did not have to die for oil, much less for his country, in the chaos that we helped create in Iraq. Why? Because the foundation of our American governmental system -- the legitimacy that is passed to our national and local leaders in the voting booth through the majority consent of the governed -- has been taken hostage in Ohio, where Lady Liberty lays still, locked in chains and stained with the disrespect and disdain heaped on her by the lawless elements of the Republican Party.

Ohio certainly isn't the only place where our government institutions are held hostage today by people who have no concept of (or respect for) our democratic foundations, the bedrock that first made this country unique and then helped us ascend to a leadership model for all peoples of the world as the bastion of personal freedom and popular control of government. Similar treasonous plots were implemented in too many other 2004 battleground states and they are still moving forward, recklessly and relentlessly, in all states (including Tennessee) today. Through the illegal manipulation of our election process, we have fallen under the control of immoral and unpatriotic traitors to the American ideal. We must not -- you must not -- allow this to stand.

Nine months ago, two small but brave and fundamentally American political parties -- the Greens and the Libertarians -- undertook their own mission in Ohio to rescue Lady Liberty. They did so because they understood what had happened in Ohio and they also understood that to sit silent in the face of the kidnapping of our votes was to be complicit in the crime. To your credit (and with the prayerful thanks of millions of your supporters), you and John Edwards joined in that rescue attempt by entering as partners in the Cobb v. Blackwell lawsuit to demand -- once and for all -- that the votes in Ohio be counted as they were cast.

Now nine months later, I awoke this morning to read that you are considering withdrawing from this lawsuit and abandoning the Greens and Libertarians up river, low on ammunition and within sight of the prison camp where Lady Liberty remains, almost breathless yet still clinging to the hope that help must be on the way. Senator Kerry, say that it isn't so. Remind us all that your wounds in Vietnam came while facing the enemy, not while running from them. Refresh our memories of a warrior who would not leave any soldier behind, for any reason. Do not withdraw from the Ohio battlefield at this critical hour when the battle -- when the future of our country -- still remains in the balance.

Today, Iraq is not our Vietnam -- Ohio is. As a country, we have more to lose if you abandon our fight for free, fair and verifiable elections in the Buckeye State than we could ever lose in the sands of the Middle East. Because if you abandon the Greens and the Libertarians on the battlefields of Ohio, if you leave Lady Liberty there to die -- alone and abandoned -- in chains in Kenneth Blackwell's basement, then you will demonstrate for all time that in America, every vote is no longer sacred and American democracy in the 21st century really is a sham.

I don't believe that. You don't believe that. The majority of Americans who supported you and John Edwards (and Al Gore before you) also don't believe that. Don't abandon the Ohio battlefield at this eleventh hour. More Americans now believe that the 2004 election was stolen (40%, in recent surveys) than believed that in late November, 2004 (about 19% back then). We are on the verge of lancing the festering wound that is the Republi-Nazi wing of the opposition party, and freeing our country from their influence and control. Now, more than ever, the Greens and Libertarians need your continuing support in Ohio. And so does Lady Liberty.

I am proud to have registered 909 Tennesseans to vote for you as our rightful President. Prove to all of us that you remain the best choice we ever made. I gave a sizeable contribution to the Kerry/Edwards campaign in 2004, specifically because of their vow to make sure that every vote would be counted and every vote would count. In the end, the 2004 election was so full of fraud and voter suppression that that was far from the case. David Cobb and Michael Badnarik STILL have an ongoing suit in Toledo OH Federal Court, Cobb v. Blackwell, regarding the flawed recount they got in 2004. The Kerry/Edwards campaign had filed papers in the case supporting the the Greens and Libertarians in the case.

While obviously this suit isn't going to change the election results, the hope is that it might preserve any evidence that is still left, and most importantly, set a precedence in case law to help keep this from happening again in future recounts. Not to mention the fact that it just might keep Blackwell from getting away with his misdeeds and moving on to higher office!

Who's "got our back" now to prevent another stolen election? I put my faith and trust and hard work, as well as my money, into Kerry/Edwards last year. Please don't let me down. Keep fighting the good fight in Cobb v. Blackwell!

Please don't disappoint us in Ohio again by pulling out of the lawsuit against Kenneth Blackwell. We Can't let him win this. As you can see, he, along with Taft and Tom Noe, Damschroder, Petro, Voinovitch and the whole Republican party in this state are crooks. Please help us save our state and help us repair our voting rights here in Ohio. Please help us. Don't pull out of the lawsuit in Toledo, Ohio.
