Judge David O. Carter Follows Federal Procedures, Orly Taitz And Alan Keyes Declare Victory
Edited on Wed Oct-07-09 02:20 PM by WeDidIt
In a purely procedural move, Judge David O. Carter submitted the following order today:

UNITED STATES DISTRICT COURT
CENTRAL DISTRICT OF CALIFORNIA
CIVIL MINUTES - GENERAL
CV-90 (12/02) CIVIL MINUTES - GENERAL Page 1 of 1
Case No. SACV09-0082 DOC (ANx) Date October 5, 2009
Title CAPTAIN PAMELA BARNETT, ET AL. V. BARACK HUSSEIN
OBAMA, ET AL. Present: The

Kristee Hopkins Debbie Gale N/A

Cause called and counsel state their appearances. Argument by counsel. Motion taken under submission.
On September 8, 2009, the Court previously set tentative case management dates. The Court now orders those dates be made final. Case Management dates are as follows:

File Motion for Summary Judgment November 16, 2009
Opposition to Motion for Summary Judgment November 26, 2009
Reply to Motion for Summary Judgment November 30, 2009

Case 8:09-cv-00082-DOC-AN Document 81 Filed 10/05/2009 Page 1 of 1

This is standard in any case and these issues were taken care of during the hearing for the motion by defendents to dismiss. In fact, the document being quoted by is from the minutes from that hearing!

But that's not what Orly thinks, nor what she tells her client, Alan Keyes:

Judge Confirms Eligibility Trial to Proceed

By Alan Keyes
October 7, 2009
Loyal to Liberty

I just received a call from Orly Taitz, my attorney in the case seeking proof of Obama's eligibility for the Office of President of the United States. Judge Carter has released a statement declaring that the dates he set for the hearing and trial on the eligibility issue are confirmed, and it will move forward as scheduled. Apparently he was not swayed by the Obama lawyer's arguments.

Link to Alan Keyes batshit insane declaration of victory on the America's Independent Party website.

Obviously, this incompetent attorney has decided the general civil minutes form the hearing are an order declining the motion to dismiss. Unfortunately for our batshit insane antagonist, no ruling on the motion to dismiss has been handed down.

And the Freepers go wild in an Orlygasm!!! Little do they know their dreams will be crushed when the ruling on the motion to dismiss is released.

1. OK help me out here
I don't do legal briefs.

Can this case still be dismissed before it goes to trial?

2. There has been no ruling on the Motion to Dismiss
All this document does is housekeeping.

Should the motion to dismiss be denied, there will be additional motions. In fact, a motion for summary judgement would probably rule that Obama is a natural born citizen any way as the current COLB would be entered as evidence and that would be the end of it forever more.

3. Thank you for posting
I thought that was the case but reading legalese makes my eyes glaze over after a paragraph or two. Do you think he'll dismiss this case and if so, when?

14. In the highly unlikely event the Motion To Dismiss
is denied, the DOJ will take an interlocutory appeal to the 9th circuit, which will squish Carter like a bug. But Alan Keyes has a better shot at getting elected President of the United States than the birfers have of surviving this Motion to Dismiss.

5. This looks like a computer generated notice
This looks like a normal computer generated docketing notice. There has been no ruling on the merits of the govt's motion to dismiss. The fact that the freepers think that this notice means anything is rather sad

10. It's a minutes order. It's housekeeping, but the Freepers are too
stupid to understand it.

It's funny--they really think Keyes and Taitz just won something.

12. or is he just "stupid" enough to know that making this announcement
will probably trigger an increase in donations to support his upcoming 'trial' -- money that will simply line his pockets?

19. This has to be one of the stupidest things yet
from the freepers. I just kept reading that OP over and over, because I thought I must be missing something. Probably because I'm a lawyer. Maybe more because I keep underestimating how stupid and gullible some of my fellow citizens are, and the lengths to which other citizens will go to lead these idiots on.

My bad thought for the night is that I hoped, for just a moment, that these same idiot freepers will follow their leaders and not get swine flu shots, that the pandemic will turn lethal, and that nature will complete the necessary "house cleaning", without too many of the good guys in life getting caught in the same net. If there is any truth to survival of the fittest, then their inability to comprehend things or react appropriately may result in their numbers dwindling due to Mother Nature's uncaring sweep of humanity via this flu. I have about had it listening to them swear the flu vaccine is a plot to sterilize white people, that it is a government plot to eliminate their righteous cause, blah blah. Possible hypocrisy note on this: I am not going to be in line for the first wave of vaccine, but I guess I like my reasons better than theirs, as I don't think it is a plot against anyone. Once I am convinced the vaccine is safe even though rushed, and that my odds of catching the flu are the same as others, I will get it. If I was in contact daily with the rest of my community and beyond, as I assume most freepers are, it would change my perspective.

I am almost just that sick and tired of these unthinking, aggressive, society endangering morons.

23. I am not an attorney
and Orly Taitz is so incompetent as an attorney that she's been worht about ten months of comedy gold.

"This incompetent attorney" is a direct reference to Orly Tiatz in the context of the sentence, but you guys just don't get context, do you?
