Not only Democrats expect to use a Hayden nomination to revisit the legality of the surveillance, however. Senate Judiciary Committee Chairman Arlen Specter (R-Pa.), who has held four hearings on the matter, said he may try to hold up Hayden's confirmation if the administration does not provide more information about the eavesdropping. He said he would try to persuade fellow senators to use the confirmation as "leverage."

"I was briefed by General Hayden and I got virtually no meaningful information," Specter said in an interview. "Now with Hayden up . . . this gives us an opportunity to ask these questions and insist on some answers if the Senate is of a mind to deny confirmation."

1. I'm certainly of a mind to deny nomination to a guy who helped
engineer unwarranted domestic wiretapping.

Good for Specter; let's hope he sees this through.

3. I don't trust Specter anymore, but this guy Hayden gives me the
absolute creeps. I hope Specter and Hoekstra lead the majority in denying this confirmation.

thanks for being the bearer of the good news. I hate having to rely on Republicans to block a bad nominee, but here again, you're right -- if these two can do the blocking, I'll cheer.

2. Regardless of how most DUers feel, I gotta prop Senator Spector.
It can't be easy to get the "Goose-Steppers for W" contingent to support him when he makes a stand (as he has increasingly lately).

Not to mention most Democrats, for pity's sake.

We ain't got many protecting the Constitution today--I'll give props when they are due.

4. I'll applaud him also, if he in fact does something and it's not all
lip service.
I seem to recall he didn't think Alito would do well but voted for him anyway, so I remain skeptical.

6. I'll second babylonsister
Specter has a long history of saying one thing for the cameras, and something quite different once the voting tabulator fires up.

There have been oppositional noises from Specter and Hoekstra, who is the Michigan Republican chairing the House Intelligence Committee, but it means less than nothing if they knuckle under to this corrupt administration again. I've seen this replay too many times to think that they're actually going to catch the ball this time, but hope springs eternal, I suppose.

Naturally, if Bush really wants Hayden at CIA, he'll just recess appoint him as soon as the Senate takes a few days off.
