I Legally Purchased A .45 ACP With No Papers Today
At a Flea Market. I had the money, the guy asked if I lived within the state and that was about it.

1. Where was this?
How much did you pay? What model, manufacturer, etc.?

I'd love to get a .45 but my wife would kill me if I did, so why make it easier for her?

2. It Happens
Trust me, and if you're not smart enough to pick up on what I've stated so far, then I'm going to give the DUers that post here on a regular basis the details.

I know them and I don't know you....

4. Your statement says you purchased a .45 caliber Automatic Colt Pistol.
If you purchased it from a private individual and if you are not prohibited by law from possessing firearms, then the private sale was legal in many states.

5. And if.......
prohibited by law from possessing firearms, you will be in jail for a while if caught with it. I was thinking of exploiting the "brother" loophole and trading shotguns with my brother.

7. Why, we need a new law!
The anti's don't really care about enforcing current laws. If we are unwilling to use the current law on the books, what good does it do to enact a new law?

25. A little late
I have a good idea where Don got it. It's perfectly legal there.

Here come the flames! Guns are personal property - plain and simple. i still don't buy many gun control arguments. I suppose I'm just too blue dog for some on this issue, but if current laws, and even pre -90's criminal codes are/were enforced, it would be/would have been sufficient.

By definition, criminals care not one whit for further restrictions. Look at a map. With our borders, firearms bans and control are no more effective than drug interdiction efforts.

8. I'm building one from scratch
Edited on Sun Nov-02-03 11:52 AM by slackmaster
No make, no model, no serial number, and perfectly legal to do even in California.

Actually all of the parts except the slide and frame are standard manufactured items. The slide and the frame (normally the serialized part) were 80% finished castings. I'm not a masochist.

10. Interesting. Is your project legal because the frame and slide are not
finished?

What percent of work must you perform?

11. BATF regulations say anything up to 80% finished is not a firearm
So you have to do at least 20% of the work.

The slide needed just a little work (several hours of tedious filing and sanding actually) to make the slots true and smooth. The frame needed to have the slots cut and fitted to the slide. All of the edges and holes needed detail work.

I'm putting in time now and then as my schedule allows. It's pretty close to finished. Probably will be done by this time next year.

14. gun show loophole
i hear so much crap about gun show loopholes. I bought a gun at a gun show and I had to go through a mandatory federal 3-day waiting period. It's evident that most people who like to get their tits twisted over the "gun show loophole" have never been to a gun show, much less tried to purchase a firearm there. The salesmen I encountered at the gun-show were wholeheartedly in support of waiting periods.

15. The federal waiting period expired when NICS took effect
The point is you got your background checked just as you would have buying the gun in a sporting goods store.

16. There are a few individuals
I will admit, there are a few individuals that will sell or trade a gun at the shows. Before the shows, they would have sold in a newspaper or the bulletin board at work or maybe down at the range.

I don't get the strategy being used by the anti's- If you want to ban all private sales, just say it. Why disguise your real intent? Why whine about the "gunshow loophole" when you are really concerned with banning private sales of firearms. Come out and say it, don't pussyfoot around! You want all gun transfers conducted at a gun store right?

17. Wcross, I doubt that most supporters of "closing the GSL" understand
Closing the Gun Show Loophole is mostly bumper-sticker politics. People are by and large so uninformed about gun laws, rules, regulations, and procedures that it doesn't enter their minds that closing the "GSL" would be like putting up a fence around 2% of your property's perimeter and declaring that your horses are now safe and secure.

18. I understand the difference
The same regulations that apply to new sales from dealers should apply to EVERY private sale. There is no "gun show" loophole. It is a "private sale" loophole.

Change the law and end it now.

19. Another law?
Will this be yet another law that won't be enforced? Its getting to the point that a law degree is required to even own a firearm!
How about going after the over 100,000 people that tried to buy a firearm from a dealer and were denied? How about using project Exile nationwide? More laws are about as useful as a bucket of shit if the laws we already have aren't enforced.

21. Now the rest of the story........
Private sale background checks can't be done without registration of all firearms. Registration has always been followed by confiscation. Now what were we talking about again? Oh yeah, your motives are suspect, your goal obscured.

Why don't you tell us what your ultimate goal is? At what point will you agree that we have all the needed gun laws? I suspect when no guns are allowed to be in private hands.

22. On this point I must disagree with you just a bit
Edited on Mon Nov-03-03 11:19 PM by slackmaster
We have background checks on all transfers here in California. Only handguns are registered (meaning the state knows where every handgun sold here since 1968 is supposed to be at any given time).

We do not have registration of long guns. It IS possible to conduct background checks on all sales without creating a registry. All that is needed is for private sellers to have access to NICS.

I'm on a long-term project to write up a detailed plan for what MrBenchley diplomatically calls my "cockamamie scheme" to make that happen without creating a gun registry.

27. NICS check is perfectly acceptable to me
That would be a great idea to allow anyone to run a check. If I were to sell a firearm, I would run a check if it was available. As it stands now you are forced to go to a gun store and pay 5-15 bucks for the check.

...very refreshing. And <drum roll> I even agree with you. If we're going to add to background checks it should cover all private sales and not just gunshows.
