"Justices to consider gun case Nov. 9"

"The Supreme Court will consider two petitions growing out of the Second Amendment dispute over a District of Columbia ban on private possession of handguns at its Conference on Nov. 9, according to the Court’s electronic docket on Wednesday.

The two cases are the city’s appeal — District of Columbia v. Heller (07-290) — challenging a D.C. Circuit Court ruling last March striking down the handgun ban under the Second Amendment, and a cross-petition by five city residents — Parker v. District of Columbia (07-335) — seeking to join in the case to add their own legal complaints about the city gun control law.

Because the two sides have framed the Second Amendment question in different ways in their papers in 07-290, it is conceivable that, should the Court grant review, it might choose to rephrase the issue itself.

The earliest that an order on the fate of the two cases would emerge is probably Tuesday, Nov. 13. The case, if granted, would probably be heard in February or March."

2. No opinion until Spring of '08 I guess

I don't think that there will be any refinement or restatement of the issue next week. I believe all we'll hear next week will be a straight forward decision of granting, or not granting, certorari.

This will be followed almost immediately by an endless barrage of fund raising letters from the Brady Bunch to fund their amicus brief, tell us that if the decision is upheld children will be able to buy machine guns in dime stores and once again "blood will run in the streets over parking spaces ... again" if we don't write them a check immediately (are there still any dime stores or are they all dollar stores now and I'm just showing my age again) and remind us all repeatedly of every line of the dissenting opinion in the DC Circuit decision while totally ignoring the majority opinion.

4. Just to clarify, the D.C. law that bans the possession of rifles and shotguns
in a functional state inside your own home is also under SCOTUS review, as part of the same case (it was explicitly struck down by the lower court as well).

5. i hope they take it
....cause it seems like the districts argument is completely emotionally based with no facts. Im surprised their legal team actually allowed them to use this argument "whatever right the second amendment protects, it doesn't allow for the district to stand by while its citizens die" such an argument can be showed to be false with a search engine.

WASHINGTON — The U.S. Supreme Court held off Tuesday on deciding whether to take up a high-profile case on killing a Washington, D.C., ban on handguns, leaving observers guessing what the court would do next.

The court has not heard a case involving the Second Amendment — which covers the "right to bear arms" — since 1939.

Four justices must vote to grant an appeal that would allow the high court to hear the case. The justice don't always reach a decision the first time they consider taking a case. The next time the court could announce its decision about hearing the case is Nov. 26.
