Illegal Foreclosure mill MERS has been referred for criminal prosecution!!!
MERS, esp. in Ala. has illegally foreclosed on thousands of homes.
It is NOT a bank, owns no titles or mortgages, it is recording facility only, yet has foreclosed.
Now, FINALLY, a criminal charge referral:

SECRETARY BRUNNER OUTLINES TWO LINES OF ATTACK IN FIGHTING HIGH OHIO FORECLOSURE RATES

COLUMBUS, Ohio – Ohio Secretary of State Jennifer Brunner, Ohio’s chief elections officer and the state officer responsible for licensing notary publics, today issued a directive to boards of elections that foreclosures cannot be used without further investigation to disqualify voters and revealed that she has referred specific instances of notary abuse occurring at Chase Home Mortgage in Columbus and by the Mortgage Electronic Registration Systems, Inc. (MERS) to a federal prosecutor for investigation.

1. Just read in the Palm Beach Post about a man who paid cash, cash
mind you, for his home and BOA served him with a foreclosure notice. The guy is scared to death and says they are persistant and harassing him even with all of his paperwork... I'll go look for the link but it is on the front page of www.pbpost.com

2. I saw that.
He needs a lawyer, fast.

See, the Mortgage bonds that the banks sold were made up of bad mortgages.
In order to pay off the bonds, the banks have to come up with money, there is decreasing money because homeowners can't pay the mortgages that the bonds are based on.
So the banks are foreclosing to make money to pay off the bonds ( which are owned by pension funds AND Fannie Mae and Freddie Mac, and lots of foreign owners...too big to fail, ya see).
Banks desperately trying to keep the scheme afloat while not admitting they DESTROYED the original wet ink mortgages and instead "electonically recorded" them ( thus MERS.
But legally you have to have a wet ink title and mortgage, to sell a house, and also to pay the mortgage on it.
To date, banks have been able to CLAIM they own the title, without producing it.
That game is up now, too much wide spread publicity.

See the problem? It is getting bigger and bigger.
I have no idea who has the actual title on our mortgage.
I have no idea if I pay off the mortgage who has the power to give ME the paid off title.

3. I'm wondering if he bought a house in the midst of a foreclosure and
there were liens, etc. Asking them to produce the mortgage should be the first reaction, I don't know if he did that or not. As to your problem, that is a problem. I would go to the County and get that verified quickly.... BOA has become very corrupt and my younger son is still banking with them. I've begged him to go to a Credit Union, but "work, don't have time, etc." are the excuse. Kids!

4. Well, we are in no danger of paying it off for at least 8 years.
I plan a visit to the County Courthouse, which is conveniently a few blocks away, to look our title up, but I suspect that MERS is the only one which will show.
I plan to talk with the Probate Judge, see how he feels about the county missing out on all those fees when homes were transferred from mortgage office to BOA to MERS to Fannie Mae with no transfer fees paid.
And I got no notice of title transfer beyond BOA.
Wonder how many homes have been sold with no legal title in the last 8 years around here.


Then again, sleeping dogs and all that, eh?

6. As I understand it, he bought the house from the bank that had
foreclosed on it -- then they forgot to stop the foreclosure process. Some time later, they foreclosed it out under from him -- the new buyer -- and sold it to someone else.

Quite a racket they've got going!
