Tuesday, the Pentagon released a memo from 2003, said harsh interrogation techniques were OK, as long as there was no "intention" to torture. From the Associated Press report:

"'Our previous opinions make clear that customary international law is not federal law and that the president is free to override it at his discretion,' said the memo written by John Yoo, who was then deputy assistant attorney general for the Office of Legal Counsel. The memo also offered a defense in case any interrogator was charged with violating U.S. or international laws. John Yoo is on the law school faculty at University of CA Berkeley. Bush vetoed the mild effort Congress made to limit waterboarding by the CIA. The Bush administration wrote the Military Commissions Act to include immunity for future criminal prosecutions against themselves. We reported on the courageous Easter Sunday protest of the Catholic Schoolgirls Against the War. The Chicago media has published their mug shots. They have received death threats, and face felony charges of destruction of property (fake blood spilled on carpeting). The Chicago chapter of World Can't Wait is circulating a support petition, asking the Archdiocese of Chicago and the Illinoi State Attorney to drop the charges.
