A Republican judge refused to say he'd allow Earle's evidence to be entered at trial, so Earle dropped the indictment. Earle had seized some documents that clearly proved Hutchinson's guilt, but the Repugs claimed the seizure was illegal. Earle feared the Repug judge would disallow that evidence.

This is a one count indictment of a state felony. To use the kid's term...and it does apply...This isn't a Federal crime. The word is he is going to plead nolo contendre (no contest ala Bill Clinton) and get fined. The reasoning is he did this to avoid being indicted on bigger, federal charges.
