FL Sheriff used state records to hunt down LTTE critic
ORLANDO, Fla. (AP) - Orange County's sheriff used driver's license records to contact a woman who wrote a letter to the editor of a newspaper criticizing his staff's use of Taser stun guns and describing him as fat.

Some say Orange County Sheriff Kevin Beary violated federal privacy law when he had his aides use the records to get the address of Alice Gawronski. He sent her a letter accusing her of slander.

It is illegal to access a driver's license database to obtain personal information, except for clear law-enforcement purposes, under the U.S. Driver's Privacy Protection Act of 1994.

"I recently read your slanderous remarks about the Orange County Sheriff's Office in the Orlando Sentinel," Beary wrote Gawronski on March 23. "It is unfortunate that people ridicule others without arming themselves with the facts before they slander a law enforcement agency or individual."

Gawronski said, "I thought I was exercising my First Amendment right of free speech - expressing an opinion in an open forum about a paid public official." She considered Beary's letter a form of intimidation.

4. Yes but the standard is very high
You have to a) write something untrue and b) know it is untrue when you write it or show no attempt to verify the truth of the statement. To sight one successful example Mary Rose Ockar sued the Cleveland Plain Dealer for libel and got a settlement.

I have friends who are cops and they can't even access unlisted phone records without a court order.

The sheriff violated her privacy and should be held accountable.

12. Well, Sheriff Barry Kenny is fat and so are a lot of southern sheriffs
....why should the guy be upset about that, as for looking up drivers licenses, the police have total access to drivers permits and licenses.

5. I would like to see a copy of the letter, but...
there is nothing slanderous in arguing that Tasers shouldn't be used. And while the definition of "fat" is subjective, I would have to say that 5'10" and 290 pounds qualifies.

10. Many of us have written LTTEs that could have ticked off "officials"
It's one of the best ways that the individual is able to enter community dialogue. This kind of intimidation is horrid and frightening.
