TAMPA, Fla. - U.S. District Judge James D. Whittemore has seen fallen preachers, a motorcycle gang leader and a crusading Cuban ballplayer in his courtroom before becoming the latest member of the bench to be drawn into the Terri Schiavo right-to-die case...

"He is a highly, highly regarded judge," said Tampa lawyer John Fitzgibbons. "He is highly intelligent and has just an excellent judicious temperament. He will allow all sides to state their position, to have their say."

Whittemore, appointed to the federal bench by President Clinton in 1999, is not known to display any political leanings.

Fitzgibbons said those who have criticized previous rulings in the case will not have an easy time accusing Whittemore of bias.

"He will call it as he sees it. You could not ask for a better or fairer referee," the lawyer said. "Everyone will be treated very fairly. It's almost a shame that there are not cameras allowed in federal courts. It would be such an incredibly fair proceeding it would be good for the country to see."

2. I think that's Judge Greer, but it's hard to keep track...
after all, I think 20 "activist judges" have now sided with the husband. :crazy:

Was to give the impression that he deliberated over the Schindlers' claim as long as he could...

Rather than just dismiss it out of hand as meritless crap, which is exactly what it was.

... and he's a conservative Republican! My head asplode!!!!!! People need to hit on that point in reply to the Clinton smear on the new(er) judge who heard the case (again).

Face it, **any** judge who doesn't deliver the desired outcome among those who want Schiavo alive at any cost will be labeled "activist" and spat upon.

This is a form of sour grapes... period.

Listening to as much of Novakula as I could this afternoon, the GOOP talking points and exploiting of this issue are clear...

This regime knew that if the case was thrown into the Federal Courts it would land on this desk and had their ammo all ready. Legally, this case is cut and dried...any judge who rules contrary has only done so under political pressure from the right wing and it's usual intimidation tactics. My kudos to this judge for doing the right thing and not hesitating.

Next, we'll hear the drumbeat on "activist judges"...which is what I think this whole thing is about. This regime wants to pack the Federal Courts with wingnut judges who will do their dirty work for decades to come. These hypocritical goons are trying to do exactly what they say hate...creating their own activist judges who will rule from party dogma first and justice last.

Then, when the time comes that Terri passes, the GOOP will use the votes Democrats took to uphold the law and court rulings and label them as "killers" and the ones who "starved this poor lady to death". Novakula put out all of these in just the 30 seconds I could stomache.

This is pure political theater and another attack in the culture wars that the Repugnican party uses to destroy this country. And the sheeple don't care...as long as American Idol isn't interupted.

7. I heard on my local "lefty" station here in San Diego, this morning on
the Stacy Taylor Show-- Stacy said by the end of today the repukes will all be calling this judge a Clinton Appointee Activist Judge. They are so predictable! I can not understand why anyone with half a brain (no joke intended) can't see through all their lies!

9. It's extremely unlikely that the three judge panel in the 11th Circuit
were all Clinton appointees seeing as how only three of twelve were appointed by Clinton and all the rest were appointed by republicans, including the recess appointment of Pryor!

And all it would take is one of the three to disagree with allowing Whittemore's ruling to stand and the tube goes right back in.

11. I can see the headline: CLINTON KILLS TERRI SCHIAVO!
As usual, blame it on Clinton and his damned activist judges.

Then Bill Friste will go get his nuclear option and kill the filibuster for voting on judges to the Supreme Court.
