"The Vermont Supreme Court in 1990 ruled that executive privilege allows a governor to keep confidential documents that reflect "advisory opinions, recommendations, and deliberations." In other words, the paper trail that shows how the governor came to a decision can, and usually is, kept secret."

'Can' and 'usually is' kept secret...hmmmmm.... :freak:

"As we leaf through the files, Archivist Gregory Sanford stops down for a look. Dean is the third governor that Sanford has dealt with on their gubernatorial papers. He says that the closed files seldom contain embarrassing information."

Seldom contain embarrassing information?

"With our limited experience with executive privilege records, there doesn't appear to be anything that is of embarrassment, if that is a criteria. My understanding in negotiating with several recent administrations now, is that it's a desire protect the decision making process, the free flow of ideas within an administration."

no one has abused it. Of course no one was interested till Dean ran for president

Hey, I'm not saying there is something embarassing in Dean's sealed records. There is no way of knowing. Certainly the archivist saying he doesn't know of anything embarassing in OTHER governor's records has no bearing one way or the other.

If it was good enough for the Continental Congress in order to write our Constitution, I don't see why it's not good enough for our governors. The Cont. Congress kept their records sealed for the same reason, so that the process wasn't hindered, so that every idea could be looked at, no matter how ugly it may have looked before discussion. I suppose that's why most, if not all, governors seal their records for at least a few years.

I'm not completely comfortable with Dean wanting to seal his for so long, but the concept of sealing them doesn't bother me one bit. The votes and approval (or disapproval) of bills are still there to look at.

So it's good enough for Dean? We spent a lot of threads here complaining about Cheney's energy papers and Bush's classifing the records of Clinton and Bush Sr.

"The entire political and law making process in Vermont is open to the public. Politicians couldn't hide anything up here if they tried. The only thing sealed are personal communications. I imagine a lot of it is letters people wrote to him for and against Civil Unions. If he unseals those records it could cause harm to people. Everything Dean ever did as governor is public record. Our press has reported on everything and one of the states leading journalists (who has been both critical and fair) has said there's nothing in those records to be concerned about. Can't recall his name, but he was interviewed not that long ago on a news show."
