A follow up on the Brian Cartmell Lawsuit.
As many of you may or may not know. Brian Cartmell, one of the producers of MMHA (Michael Moore Hates America, www.michaelmoorehatesamerica.com ), Tried to sue me over some satire and rather disturbing facts I had presented about him both here (IMDB) and on my LJ (www.livejournal.com/users/fulcrum9).

On the 23rd of July the Honorable Michael C, Hayden (Judge of King county Washington) threw out Cartmell’s second attempt at filing a TRO (Temporary Restraining order) against me wile doing everything BUT devouring Cartmell’s lawyers for even attempting these actions against me.
Before I even had a chance to speak the action was thrown out and Cartmell and his Lawyers had been ridiculed for their actions.
When I did speak I stated that all the posts which Cartmell had originally found hurtful to his person, had been removed completely.
What I refrained from telling the judge is that I had done this because of the rather threatening statements Cartmell had made in his phone conversation with me.
Cartmell’s lawyers had taken the pressure a step further by trying to get me to sign a rather open ended stipulation before the hearing on the 23rd.
Their stipulation would have removed my first amendment rights to free speech in this matter and also implicated any other person Cartmell’s lawyers could claim that I had an association with over these statements.
I told them that I was confident in the discretion of the judge in this matter.
Not even an hour before the hearing Cartmell’s lawyers were pleading with me to sign it and swore to me that they would win their TRO order from the judge.
Their pleas had broken down into rather unsettling and disturbing statements.
Not even 30 minuets after the hearing, Cartmell’s Lawyers called me again.
Only this time they were pleading for something quite different.
At first they had requested a draft of an apology and retraction of my statements that had hurt Cartmell.
The first draft was not to their liking and they are reviewing the second at this time.
I have given them until this Friday, the 30th of July to either accept the statement and end the case or continue with the lawsuit.
The lawsuit claims that Cartmell has suffered damages due to my statements.
But then goes on to explain that these "Damages" can not properly be estimated at this time.
Because the TRO requests were thrown out, Cartmell can not order my silence or make a proper claim that anything I have said thus far was illegal.
Since cartmell is considered a Public figure there is no basis in a claim of "Defamatory Statements" that I might have made against him.
There are also no viable claims for damages or Fault either so this further debunks the claim of "Defamatory Statements".
Furthermore there is no evidence that anything I said could ever possibly damage the earnings or "good will" of Cartmell because the majority of people who have responded to said statements have emphasized an even more powerful urge to see the movie AFTER reading my statements.
This makes a plausible claim that I have in fact increased the earning power of this movie in my satire of it.
I have also advocated that even though I believe this is the most brain dead piece of Documentary cinema ever to be proposed, I think everyone should at least field this film in the interest of being open minded to both sides of an issue.
Brian Cartmell (Producer of MMHA) does not respect the First Amendment in Constitution of the United States of America.
These two TRO motions prove that he would rather throw allot of money at something, try to scare people and cry wolf, rather then letting his own arguments and this movie, stand on their own two feet.
MY opinion was so dangerous to this person that he tried to GAG me with an order that his own lawyers KNEW, would never pass with ANY judge in this country.
They tried to scare me, they LIED to me and they used Materials from my own personal Livejournal as Exhibit Evidence in their complaint.
ONE in particular was a Livejournal post about a friend who was killed in a motorcycle accident last year.
Nothing more then that is in that one Exhibit.
How is any person’s death relevant to this case?
I asked Cartmell’s Lawyers that same question and they told me,
"We don’t care about that.".
Well obviously they do not care.
Now they want me to sign another stipulation that GAGS not only me but Cartmell as well from ever talking about me.
DOES that seam logical to anyone?
"Impossible", YES "Logical", NO.
This country is not about silence or gag orders.
I am a poor private citizen and I do not see how my words (especially after he was successful in threatening me into taking them down) are supposed to hurt someone who makes millions of dollars a year.
I have the right to my opinion and he has the right to his.
I would no more allow a gag order on my own mother then to allow one on Cartmell even though I think he is just about the most insane and evil person on this earth or at least in the top 15.
Under any reason.
I would not accept any gag order on myself under any reason either.
This is America.
I think that Wilson’s movie is a stupid idea but he has the right to make it.
I also think that he is better off without Cartmell as a producer and I would be the first in line with $20.00 that I can not even afford right now to fund his film if he would dump this communist hack from production.
In fact I would join any Wilson and MMHA fans in an effort to get this former Pornographer, Constitution disrespecting, Civil Rights bending, Capitalist pig off of the production credits for this movie.
Because I believe Cartmell has Duped Michael Wilson into allowing him onto the production credits.
He is ruining what credibility this film might have had and he is making Wilson look like a party to truly anti-American Ideologies.
With the TRO motions gone, Cartmell’s case has nothing to stand on.
Yet they still beat around the bush with me trying to save face in some statement I will never sign as long as they continue to try shutting people up for no reason and with no legal grounds.
So I am stating this all Here and now because, like I said before, I am not afraid of this man or his money and If he was at all an honorable person then he would be able to face the music just like we all have to every day.
Because we are Americans no matter what we think.
