Calif. secretary of state bans electronic voting in four counties
Eds: Also moving on financial lines

SACRAMENTO, Calif. (AP) -- Citing concerns about security and
reliability, Secretary of State Kevin Shelley banned Friday the use
of touchscreen voting machines in four counties.
Shelley said he may expand the ban to 10 other countries if they
do not meet a score of conditions.
The ban immediately affects new computerized voting machines
manufactured by Diebold Election Systems, the leading touchscreen
provider. Many of them were used for the first time in the March
primaries.
"We are acting boldly and responsibly to improve the system in
time for November," Shelley said.
But the decision means more than 2 million voters in San Diego,
Solano, San Joaquin and Kern counties could see paper ballots in
November, marking their choices in ovals read by optical scanners.
The decision follows a series of failures of touchscreen
machines in primaries this year.
Computer experts have criticized the machines, primarily because
they provide no paper record, saying they are susceptible to
hacking and malfunctions.
At least 50 million voters were expected to use the ATM-like
machines from Diebold and other companies in November.

6. Hope we can use this as a precident in other States.
There's been a lot of fighting in Ga. about these touch screen machines. Especially after the 2002 vote where there were so many surprise upsets like Max Clelland and our first Repub Gov. in 130 years!

9. Ban the black boxes

Having paper receipts on them are useless. Paper receipts are only useful in case of a close enough race that would require a recount by law. To get around this, Diebold would only need to rig the vote by a large enough margin to avoid the recount.

Lets take a cue from the Irish. 100% paper ballots are the only way to go!

The 'voting machines' will ONLY print the ballot with the voters choices ....

Who will then REMOVE the paper ballot, and VERIFY it has the proper votes before he drops the 'voter machine' generated and personally verified paper ballot into the ballot box .....

There is NO objection to using machines to PRINT the ballots ... Its the 'DRE" part that is problematic ...

We also still have problems with optical scanners, which can also be comprimised ...

One possible solution I have read about to this is a locked metal box with a glass window on the front. The tape passes in front of the window, the voter reads it, confirms their choices, and the tape is cut and dropped into a second sealed box. Two different people have the keys, so to open and collect the paper receipts requires at least two people, plus a possible third to actually remove the box from the machine proper.

Tedious, but necessary, IMO, if we're going to use the voter verified paper trail option.

The subtleties of what you just wrote will take a while to percolate up into consciousness. Keep repeating the message --

If touch screens are used, the best way is to have them act as a printer only, never a vote recorder plus printer.

And optical scan systems have problems too: Washington state, they never were certified at all. And the central tabulator is a security nightmare.

What does that mean? Why would anyone in their right mind install these expensive voting machines just to use them as printers? That makes no sense.

There are two systems that are NASED certified, one with open source code (TruVote). The TruVote and Accuvote system printing technology can be retrofitted to Diebold voting stations.

To view how TruVote works: http://www.truvote.com. The owner of TruVote, and also the inventor of their voting technology, Athan Gibbs, was killed in a collision with an 18 wheeler truck on March 12, 2004, in Nashville Tennessee, on his way to work. He was demonstrating the technology around the country, which because of the simplicity and auditibility should have put the big vendors out of business, that is if voting administrators around the country knew anything about technology and weren't so gullible (and possible corrupt? maybe) when the big vendors were smoozing them.

Gibbs had just come down from Nashville at the request of Georgia VVPAT activists to demonstrate the technology for the Senate State and Local Governmental Operations committee which was hearing Senate Bill 500, which mandated VVPAT, about a week before his death. The technology survives him, and solves many if not all (it still uses MS OS) of the problems that are inherent with DRE voting. http://www.tennessean.com/obits/archives/04/03/48330576.shtml

However, that being said, my vote is for paper and pencil and old fashioned hand counting. There could be many solutions to how blind voters be accommodated, so they could vote in private, without having to throw away the vote of everyone else,

Voters in all constituencies will be using a paper ballot rather than voting electronically on 11 June following the publication of the interim report of the Independent Commission on Electronic Voting.


More time was needed for further testing of the Nedap/Powervote electronic voting system and the commission could not recommend using the proposed system at the local and European elections and the citizenship referendum due to be held on 11 June, reported the 5-member commission Friday. Although the commission's remit was advisory, the government had said that it would abide by whatever recommendations were made.

17. Part of the proposed solution is a random audit of a percentage.....
.....of all the ballots or paper records in every election to look for problems with the machines. If the paper totals don't match the machine totals then all of the paper is counted. :evilgrin:

I would think that either they think there is nothing wrong with the machines or they believe that the machines will be rigged to make Bush the winner.

If Repubs thought that we were going to rig the machines they would have been gone long ago.

35. electronic ballots don't necessarily need to be banned forever
They only need to be made secure. The only tried and true way to do this is to make the code the machines run completely open source. As in, compile and run it on your livingroom PC.

Let the script kiddies and true hackers around the world find and plug every single security hole there is. Cheaper and more reliable. Public and open, but secret results until the count.

In light of those fact, one wonders why the code is presently secret. Ulterior motive, anyone?

27. I agree with you but what he banned was the TSx machines......
.....used in four counties. The other DRE (Direct Recording Electronic) machines in use are the AccuVote TS model. All the machines were found to be using uncertified software in previous elections.

They all should have been banned IMHO. :evilgrin:

Where are the Secret Service and FBI cyber-crimes guys when you need them? :shrug:

29. Yes, Diebold doesn't need them to be in every county

to fix the election for Bush. Just having them in a few counties would be enough to do the trick.

Shelley should know better. It would be pointless to ban them in only a few areas of the state. The election here is compromised as long as they exist in CA at all.

28. Get on the Horn to Shelley- And Let Him Know You Support Him!
Shelley is going to get a lot of flack from the Diebold county election officials who are so sold on voting without proof.

In reality, these people should face lawsuits of their own, for purchasing uncertified equipment in the first place. Not one contract line should have been signed without it, irregardless of the paper issue.

Shelley is a hero and he deserves your support and recognition. This isn't everything, but it is a HUGE first step!

Which machines are considered scary because of no paper trail? I know that Diebold's machines can be hacked in less than five minutes with no trace of the hacker's escapades.

History of the Controversy So What’s the Big Deal?
• Before the 2000 election, a private company wrongfully purged over 50,000 voters from the Florida voting rolls.
• Ballots that were undecipherable or otherwise faulty plagued the Florida election.
• After the 2000 election debacle, Congress passed HAVA, the "Help America Vote Act."
• Using HAVA funds, many states are rushing to buy the newest electronic "touch screen" voting machines.
• The private companies that create these machines assert that their software is a trade secret.
• This fall, Renton activist Bev Harris broke the story of the problems with these machines in her acclaimed book, Black Box Voting, Ballot Tampering in the 21st Century.
• On November 24, voting activist Andy Stephenson began his campaign for Washington’s Secretary of State, the state’s top elections official. Andy believes election officials should work for voters’ rights not corporate rights.
• What was always intended as a transparent and public process—counting our votes—is now subject to the veil of corporate secrecy.
• Computer systems are vulnerable to glitches, software errors, and tampering. Problems plague elections throughout the nation and even worldwide.
• No voter, no citizens' group and no academic experts are allowed to verify the integrity of these machines, either before or after the election.
• The elections software that was (accidentally) made public is riddled with security holes.
• No paper trail exists to verify our votes so recounts are impossible; your vote is whatever the machine declares it to be.
• Wholesale and widespread vote fraud is virtually undetectable.







What can I do to ensure our elections remain free and fair?

1. Demand that a “voter verified paper ballot” be used to randomly audit all elections
2. Demand a paper “ballot” not a paper “trail”. We have a 200-year tradition of ballots. Only paper ballots should have legal standing as the arbiter of the vote.
3. Demand proper auditing procedures of voting systems, and impartial voter registration.
4. Demand Publicly Owned Open-Source Software!




“Voter-Verified Paper Ballots” not “Paper Trails”
• In order for the paper ballot to be a truly separate audit layer for election officials to validate the accuracy of the machine count, the paper must be the final legal record of the vote count. In short, the paper hand-count must trump the machine count.
• Currently, in the State of Washington, machines with ballot cards, like the Diebold Optical-Scan units used in King County, use the machine count as the legal record of your vote. In the event of a recount, the “ballot cards” are simply fed into the machine again. So if the machine is altered, and the software is hacked, the “recount” is simply the same process all over again. This is not a proper way to audit the system, and will not catch malfeasance.
• Hand-counting the paper record, and comparing it, openly and in public, to the machine count is necessary to ensure both accuracy and public trust in the system.

Proper Auditing Procedures
• Voter verified paper ballots allow each individual the ability to audit their own ballot, the legal record of their vote, before it is placed in the ballot box.
• Individual machines should print reports before being transmitted to any central tabulation unit, and these reports should be made public
• Random 5% hand-recounts of paper ballots compared to machine count should be mandatory for all elections.
• Precinct level tally reports must be posted publicly before transmission.
• Proper chain of custody rules in handling absentee ballots should be established.
• Contracts with private companies for the collecting and sorting of our absentee ballots should be terminated immediately.
• New rules to eliminate corporate owned and operated for profit corporations from controlling the vote count software should be established. Vote counting software should be written on a for-hire basis, and should be retained as a public good, the code should be owned by the people, and open to inspection by the people.
• Open Source Software allows computer scientists the ability to audit the code.
• Voters and all citizens must take an active role in monitoring their own elections systems, and officials.

I wrote to every level of elections officials last year. The locals were willing to humor me, but spent the $$ anyway.

Time to remind them they need to take their responsibilities a bit more seriously.

Our counties did not have the funds to buy this junk because of *'s war.

Demand a refund!

That website has a great overview and history and may answer some of your questions.

As far as "Which machines are considered scary because of no paper trail?"

The answer is, all of them.

For documentation of this from credible authorities, check out the resolution signed by 1700 technologists (last time I looked) at the verifiedvoting website who said that "Voting machines should not be purchased or used unless they provide a voter-verifiable audit trail." http://www.VerifiedVoting.org/resolution.asp
