Israel follows its own law, not bigoted Hague decision (Alan Dershowitz)
The Israeli government has both a legal and a moral obligation to comply with the Israeli Supreme Court's decision regarding the security fence.

After all, the Supreme Court is a creation of the Knesset and is therefore representative of all of the people – Jews, Muslims, and Christians alike. Moreover, the Supreme Court has a real stake in both sides of the fence dispute. Its job is to balance the security needs of its citizens against the humanitarian concerns of West Bank Palestinians. It tried to strike that balance by upholding the concept of a security fence while insisting that the Israeli military authorities give due weight to the needs of the Palestinians, even if that requires some compromise on the security of Israelis.

Contrast this with the questionable status of the International Court of Justice in The Hague. No Israeli judge may serve on that court as a permanent member, while sworn enemies of Israel serve among its judges, several of whom represent countries that do not abide by the rule of law. Virtually every democracy voted against that court's taking jurisdiction over the fence case, while nearly every country that voted to take jurisdiction was a tyranny. Israel owes the International Court absolutely no deference. It is under neither a moral nor a legal obligation to give any weight to its predetermined decision.

The Supreme Court of Israel recognized the unquestionable reality that the security fence has saved numerous lives and promises to save more, but it also recognized that this benefit must be weighed against the material disadvantages to West Bank Palestinians. The International Court, on the other hand, discounted the saving of lives and focused only on the Palestinian interests. By showing its preference for Palestinian property rights over the lives of Jews, the International Court displayed its bigotry.

Ending the occupation of Palestine will save lives on both sides of the fence.

5. The whole idea of the fence...
is to end the occupation of the West Bank and Gaza. The Israeli Supreme Court rightly ruled that moving the fence into the West Bank, away from the Green Line, was not only illegal (because of the harm it did to both Israelis and Palestinians) but also working against this goal. So you see, the Israelis can and do work to try and stop the fighting.

This is typical Dershowitz sophistry. He often resorts to adhominem attacks. For example, when Norman Finkelstein caught Dershowitz plagarizing, Dershowitz attacked Finkelstein rather than address the issue.

Here Dershowitz is calling the court irresponsible by implication of its members. Israel cannot have permenant member on the court. So what? Most coutnries can't, as far as I know. Some members are countries who are sworn enemies of Israel. Yes, and probalby most members are not swon enemies of Israel.

As a lawyer Desrshowitiz should know he would be laughed out of court if he tried any of this nonsense before a judge or jury. You have to argue the merits of the case and law.

The court ruling was expected and follows international law as layed down since WW2. If Israel wants to build a fence, fine.

However, it cannot build it on other peoples' land and confiscate that land. Take a look at a map of the proposed route of the fence. It gobble up 16 percent of the West Bank.

Israel cannot be expected to do what is right, since it has flauted *72* United Nations Security Council resolutions. Since the latest intifadah, Israel has continued to build settlements. It has been found guilty of every human rights group of "willful killing" and "torture." Its current government has formed a coaltion with a party that advocates ethnic cleansing for Palestinians.

Nothing in Israel's behaviour suggests it can act responsibly on its own.

ethnic clensing. israel (not likud or labor) will never give up the occupied areas. they can either create a formal aparthide system (as opposed to the existing informal aparthide) or remove the arab population entirely.

if they wish to remain a "jewish" state, then they must really fuck over the non jews pretty thoroughly.

negotiate a peace. The Israeli people would then boot Sharon (if necessary) and go about the business of a solution both sides could live with.
