Judge dismisses challenge to Electoral College ballot measure
A federal judge today refused to block voters from deciding on a measure that would change the way Colorado votes for president.

U.S. District Judge Lewis Babcock dismissed a lawsuit that challenged a proposal on next week's ballot, saying he lacked jurisdiction.

The measure, Amendment 36, would scrap Colorado's winner-take-all system for distributing its nine Electoral College votes. Instead, presidential candidates a would be awarded a share of the electoral votes based on the popular vote. The change would begin with this year's elections.

Fort Collins businessman Jason Napolitano, who filed the lawsuit two weeks ago, argued that the proposal is unconstitutional because only the Legislature has the power to change the state's Electoral College system.

Between 10,000 and 12,000 of us were there to see him. I had posted pictures, but since that thread has slipped into the Archives, it can't be reached until after the election.

4. thought it was winnable
i did a lot of calls to colorado dems for kerry to volunteer, just after the debates and they were so into it... they were swearing it's closer than the rest of the country thinks, that repubs there are fed up and dumping bush right and left . they were excited.
hey, i'm in nyc, and i know qute a few former bush voters and non voters around here, and they ain't going back. there's one hold out, but he's shut his trap after i told him he was quoting old pre-debate polls.
so many people vote for who they think is going to win, and in the past week, bush has been losing them steadily!!
