MONTGOMERY, Ala. (Reuters) - An Alabama judge vowed on Wednesday to keep a monument inscribed with the Ten Commandments on display in a state judicial building after losing a last-minute appeal to the U.S. Supreme Court of an order for its removal.

"The U.S. Supreme Court's denial of a stay today will not deter me from continuing to fight for the right of our state to acknowledge God as the moral foundation of our law," state Supreme Court Justice Roy Moore said in a statement read by his spokesman hours before the midnight Wednesday deadline.

Moore's statement, read to reporters outside after the court building closed, said he would ask the U.S. high court "for an appeal on the merits" in the case. "I expect that the court will vindicate the rule of law regarding the acknowledgment of God in our state," it added.

Tom Parker, Moore's spokesman, said Alabama's top judge had "no intention" of removing the monument and that it would be guarded by security personnel on Thursday.

7. The SC denied a "stay" in the removal...
....meaning the denied putting it off. Meaning the removal is still on for tonight. HOWEVER, he can still appeal, like the article said, "on the 'merits' LOL of the case" just to be able to keep the thing there till the end of time. If they won't stay it, though, they sure as hell won't overturn it. It's like asking for five cents, and after getting denied asking for a dollar.

The denial of the stay doesn't necessarily signal that they'd
rule against Moore, although it is a pretty strong signal given
that it would have been Kennedy that denied the stay.

(You may already know this...)

You see, when it comes to "emergency stays" (of executions, rock
removals, and such like), the Supreme Court doesn't act as a
whole. Instead, each individual Justice is repsonsible for handling
stay requests emanating from one section of the country. So, for
example, if a liberal Justice had denied the stay, you might still
find the rest of the Court going 5-4 in Moore's favor on the actual
appeal. But given that it was Kennedy denying the stay, I'd say
that's a pretty rock-solid indication that the court will
eventually deny Moore by at least 6-3. But you really can't
take it for granite.

5. I've got a couple of questions.
1. As a Judge, didn't Moore have to take an oath (presumably on his Bible) to uphold and serve the laws of his state and the United States Constitution?

2. By defying the Superior Court and losing his bid before the Supreme Court, hasn't Moore broken his oath?

3. Isn't there an automatic penalty for this blatant transgression, such as being removed from the bench and/or disbarrment? (If not, there should be!)

Not just for ignoring the Constitution, but for ignoring the Supreme Court of the United States.
F*CK this guy. You DO what the SC tells you to do, dammit.

12. I'm in full support of civil disobedience...
If Judge Moore and his gang want to protest the Supremes' denial and exercise a peaceful sit-in around his precious monument, I have no problem with that. HOWEVER, prior to doing so, he should resign his seat on the bench. Otherwise, he fairly mocks our judicial process and introduces a reasonable question - which master does he serve? The people of Alabama (ALL of them, including the atheists) or an imaginary cloud being?

My guess is Judge Roy (Off His) Bean will milk this for all the publicity he and his God-fearin' ilk can garner. They will find out, quite abruptly, that they are on the wrong side of the law...and history
