DeLay files motion for retrial on money laundering charges

AUSTIN — Tom DeLay's legal team filed a motion today asking for a retrial for the former congressman, convicted last November on charges of money laundering and conspiracy.

The motion, filed by DeLay's attorney Dick DeGuerin, seeks a new trial, citing juror misconduct, misapplication of the state's election code and the potential unconstitutionality of Texas' ban on corporate campaign contributions.

The case centered on $190,000 in campaign contributions to seven candidates for the Texas House.

3. I am all for giving every accused their rights......
but my concern is that Texas politics, and not issues of law or fact, will grant him a retrial. Further that Texas politics that thought there was no way he would be convicted the first time will cut a backroom deal to ensure he is not convicted again. And if convicted his good buddy at the Texas Governor's mansion is likely to pardon him or commute his sentence and then have a party in his honor.

5. He wants to court shop
just like the 2 (out of 14) Republican successes in the anti-Healthcare lawsuits

He was tried in Austin (LIBeral) so the jury pool was sided against him....but then he was illegally giving money IN Austin so that makes sense to try him there. Plus it is the Attorney General's prerogative.

They will try to move to some backwater (West Texas?) town where they will use the "Aw shucks his just a good old boy just like you" defense.

6. I sincerely hope he is not granted a retrial...
...but if he were, I wish it were possible to hold it in another state, since he found a Texas county too liberal to give him a fair trial. :eyes: Oh, to have lawyers cross-examining the Bug Man in Manhattan or Boston.

9. lol the "juror misconduct" was that they found him guilty...
Fuck you, Tom. Your going to prison. Cry all you want, beg for forgiveness, and spend as much money as the lawyers will take from you, but your going to prison all the same.

It feels good to get a win once in a while, doesn't it DU?
