Former GOP official resists new trial (NH Phone Jamming)
Source: Portland Press Herald

CONCORD, N.H. — A former national Republican Party official is trying to avoid a second trial on charges stemming from a phone-jamming plot against New Hampshire Democrats.

James Tobin of Bangor, Maine, was convicted in 2005 of helping to arrange more than 800 hang-up calls that jammed get-out- the-vote phone lines set up by the state Democratic Party and the Manchester firefighters' union for about an hour on Election Day 2002.

This March, the 1st U.S. Circuit Court of Appeals in Boston ruled that the harassment statute under which Tobin was convicted was not a close fit.

The case now turns on that question -- whether Tobin's intention was to harass -- as his lawyers return to U.S. District Court in Concord to seek acquittal for him.

FYI, I believe the judge is Christa McAuliffe's widower.

If his intention wasn't to harass just what was it? Other than voter suppression of course. This guy deserves to be in jail!!!

1. Exactly. Was the court saying the intent was not to harass

but voter suppression? Is the court saying retry him for that? I think that would be harder to prove.

2. James Tobin what a great guy.
And who picked up the tab for his legal fees? The RNC ....but "they" were not
involved.

And whom did James Tobin call before during and after his phone jamming?
The White House (Rove & Mehlman) .... but they were not involved.

<Phone records show Tobin made two dozen calls to the White House within a three-day period around Election Day 2002. Ken Mehlman, then White House political director and now chairman of the Republican National Committee, has said none of the calls involved the phone-jamming incident.> from Wiki

And what happen after he was arrested for the phone jamming? He got a raise
and a promotion from the Republican party.

6. Mr. Tobin Deserves What Federal Criminals Always Do
He's also making the RNC as whole look guilty. Time to spread Mr. Tobin's name far and wide in New England. Have fun Mr. Tobin,
