DeLay wants January trial date
Lawyer seeks to separate charges to speed procedure

AUSTIN - U.S. Rep. Tom DeLay is seeking a January trial on his money-laundering charge regardless of whether the Travis County District Attorney's Office appeals the dismissal of a related conspiracy charge.

DeLay's attorney, Dick DeGuerin, on Wednesday asked a judge to separate the money-laundering charge from a charge of conspiracy to engage in money laundering.

Senior District Judge Pat Priest on Monday threw out a third charge of conspiring to violate the state election code, but upheld the other two charges.

"We have a right to sever (the charges) and proceed. We want this done and over with as quickly as possible," said DeGuerin.

Travis County District Attorney Ronnie Earle has 15 days to decide whether to appeal the dismissal. DeLay's lawyers are worried that Earle may ask for a stay to halt all proceedings until an appellate court rules.

5. Did he waive his right to a speedy trial?
He probably wants to speed up the prosecution in hopes the haste creates a mistrial. The main benefit would be to wrap it up in time to reclaim his seat at the head of the congressional table.

No hurry, get it right and let him twist in the wind.

6. Actually I believe the GOP want to have an election for his position
in January. I don't really see how they can sever the charges, since they are all related. Here's hoping Earle delays Delay with appeals and motions. I am sure that is what Tom and his counsel suspect will happen. All I can say is :ROFL:

7. no. actually.....
They want to suspend the meeting of the House until the end of January. So that Delay will be able to hold his seat,after he pays off the judges of course.

The prospect of a high-profile trial next year involving DeLay -- on top of the resignation of representative Randy ''Duke" Cunningham last week for taking bribes, as well as investigations of other GOP House members -- has rank-and-file representatives growing concerned about their 2006 reelection prospects.

By demanding new leadership elections, Republican House members can send a powerful message to voters that they are addressing ethical lapses and are ready to move forward, said Representative Jeff Flake, an Arizona Republican. New leaders can also set a new agenda that emphasizes the party's commitment to fiscal discipline.

9. I don't understand what they are asking for
It would seem to me that having both charges tried at the same time would expedite the problems for Delay. Why would they want to split the charges up and have two seperate trials?

10. DeLay is entitled to all due respect which is given an ordinary citizen.
So he can just STFU and go to the back of the room like the rest of the peons would have to do, under the same circumstances. (Not that we peons would ever stoop as low as "I AM THE FEDERAL GOVERNMENT" DeLay.)

believe a criminal defendent has that right. In any case the judge needs to decide that and it will take time. Speedy trial, yes, but it is DeLay who has been making the motions which are delaying the trial so I believe he waives some of that right to a speedy trial when he does that. The judge has to have time to deliberate on his various motions.
