Appeal in S.D. mayor re-election case filed (Donna Frye)

From the San Diego Union Tribune just moments ago... Looks like the folks still are trying to fight for Donna Frye. Hope she can pull through now. With all of the ugliness of the pension fund and other corruption that's now surfacing, not only *should* she be elected due to the earlier votes in her favor, but San Diego *needs* her to start on a clean slate and get things cleaned up around here to get our credit rating back, etc.

Appeal in S.D. mayor re-election case filed

Three voters who unsuccessfully challenged Mayor Dick Murphy's narrow re-election win over Councilwoman Donna Frye filed an appeal Thursday and their lawyer promised to continue their legal battle "until every vote is counted."

The move, which was widely anticipated, opens another chapter in the lingering aftermath of the Nov. 2 election, which Murphy won by 2,238 votes over write-in candidate Frye.

The San Diego mayor's lawyer, Bob Ottilie, issued a brief statement expressing disappointment with the latest postelection

"People have a right to appeal," he said. "It's unfortunate these folks will not put the best interests of the city ahead of their personal agenda."

Attorney Fred Woocher, representing three Frye supporters who went to court to try to overturn Murphy's win, said the issues in the case are too important not to pursue.

"These are fundamental issues about the rights of the voters and how the law is interpreted, not just in this election but in future elections," Woocher said.

An appeal could take several months to be resolved. While the courts can put the case on an expedited track, it could be as long as two months before any briefs are even filed.

1. I've been living in WY too long
S.D. to me is South Dakota and, even after reading your post, I couldn't make the headline make sense. Stupid, stupid, stupid. Maybe it's time to go to bed. :eyes:

4. We truly need Donna --

Murphy was on PBS today and sounded dumb and sleazy. People who voted for him because they want a new downtown library heard him say that library hours for existing libraries will have to be cut--so they're obviously not getting a new one.

Gloria Penner mentioned that there are a lot of people who want a recall.

I hope the appeal, and, if necessary, the recall, are expedited. The sooner we get the sleaze out, the sooner we can clean up city hall.

Between Bush and Murphy, I'm getting sick and tired of people looting the treasury while insisting they won when they didn't.

Interest on our debts comes off the top of future budgets, so cuts in public spending will last for generations as our grandkids pay off the deficits these bums incurred.

That sheds light on the difficulties of getting the mess cleaned up and the controversy that newly elected City Attorney Mike Aguire is "stirring up" with his investigations and contentions with the city council and mayor (for now) Murphy... Hopefully Donna successfully overturning the mayoral election would serve to add more voices to those who want to fix things and set them right again here.

Let's disagree, agree, disagree and then agree to disagree. The Aguirre-Murphy saga press-conferenced itself back into daily life again Thursday as a humbled City Attorney Mike Aguirre suggested that his tactics perhaps were a bit harsh the past few weeks. He called on Mayor Dick Murphy to hold public hearings next Thursday and Friday to discuss the differing financial reparation proposals commissioned by the two clashing crews of city leadership. "We need to have a solid, robust discussion," Aguirre said.

In his self-reflection, he cited a Thursday editorial in The San Diego Union-Tribune calling for cooperation between the two sides - something that's been suggested for a while now from the likes of the San Diego Regional Chamber of Commerce and Fitch Ratings, the credit rating house.

Murphy did a little less soul searching: "I will consider Mr. Aguirre's request." That was his only response, given through a spokesman.

Since his first days in office, Aguirre has stirred up trouble with the mayor and many City Council members. Things came to a head two weeks ago when his investigative report accused the Mayor and several council members of breaking federal securities laws by failing to disclose the city's negative financial information. After Aguirre had muckraked his colleagues to the bone, it appeared the two sides had united last week when agreeing on a labor salary freeze and the hiring of an accounting expert to lubricate a dried-up fiscal year 2003 audit. Then, on Tuesday, Aguirre hit again with his own financial plan and several jabs at Murphy's leadership, to which Murphy later called Aguirre a "rookie" and told him to play with the team or plant his bootie on the bench.
