33. It might be different if the iPhone actually required being "pointed" at someone in order to take a


picture. But it doesn't. The lens is in the back of the phone, and it's a tiny little hole that doesn't emit a red light or anything even remotely suspicious or threatening. To take a picture with it, you hold it up with the front of the phone facing yourself... as if you were looking at the screen. Nothing threatening about that; any cop who says he was "in fear of his life" for that is looking for a reason to arrest someone. It's as simple as that.

I'd love to know what statute this guy was charged under.

And before you go calling me stupid, I know just a little bit about what I'm talking about here. Oh, and I have an iPhone, too. :)
