This type of case has been tested in court before, and the courts have ruled that if you make a deal to pay money in a case like this, you have to pay it out if someone meets your conditions. You can suddenly change the rules to fit your liking, if Kerry sues and the judge follows previously established legal precedent Kerry should have no problem winning his case in court.
