In my previous letter entitled
"Dear Gov. Dean – 'GOP wins Senate, holds House, CNN projects'," I attempted to establish the inescapable fact that Bush deceived a Republican controlled Congress in his illegal and un-Constitutional spy program.
In that letter I noted:
A brief journey through the blogosphere led me to an interesting analysis by Martin Garbus entitled
"Impeachment Is Now Real." As you likely know, Mr. Garbus is a highly skilled trial lawyer with years of experience in many areas of the law. Interestingly, his analysis of why Bush will be impeached focuses on the following:
… we shall soon see the consequences of those warrantless searches, the consequences of the government’s five years of secrecy, and even the citizens of the “Red States” will be outraged. Firstly, the warrantless taps will infect hundreds of “terrorist” and criminal cases throughout the country. Not only future cases, but past and present cases, even if there were convictions or plea bargains after the survellance started.
The defendants in "terrorist" and other infected criminal cases, the Court must find, must get access to everything, or very close to everything to make sure they were never improperly surveilled.
The Bush Administration, in these cases will refuse, as did the Nixon administration, to divulge information on national security grounds. Many alleged critical cases must then be dismissed.
It will include Organized Crime and drug cases. The entire criminal process will be brought to a standstill. Link:
http://www.huffingtonpost.com/martin-garbus/impeachment-is-now-real_b_12972.html Mr. Garbus then highlights something that, as our fellow citizens become aware of the implications of the illegal spying, will demonstrate the intent of the Administration to preemptively cover-up any and all of their misdeeds:
The American public will also learn what this Administration has thus far successfully hidden. When Bush came into office, he signed an Exeutive Order making all of his, and his father’s, papers privileged. The order, extending 12 years out, also says if the President is incapacitated, then a third person can execute the privilege. This means anybody – a wife, a family lawyer, a child. The order also says the Vice President’s papers are privileged. It is an extraordinary Executive Order – this has never been anything like this. No one ever suggested a Vice President has executive privilege. If we do not find out what they are hiding, we will see witholding on a scale never before seen. He will no longer be able to use 9/11 and the war on terror as an excuse. It will confirm the fact that illegality and secrecy existed long before 9/11, that it started as soon as Bush-Cheney-Rumsfield got into office. It will show deliberate attempts to avoid any judicial or legislative oversight of the illegal use of executive privilege.

All the DNC and aligned organizations need to do is to deliver a persistent message to every American:
The President broke the law and, as a result of his illegal actions, terrorists, mobsters, drug dealers, and others may now avoid incarceration and fines.
The President established mechanisms for hiding from a Republican controlled Congress what his plans and actions have been.
Removing this President, and those who collaborated with him to deceive the Republican controlled Congress and all American citizens, is NOT a partisan issue because he abused Republicans just as much as he abused Democrats, Independents, Greens, ….. – he abused our Nation’s Constitution and statutes.
Gov. Dean, I urge you to bring the message to all Americans –
the President has jeopardized our National Security, our judicial system, and our civil liberties. Anyone unwilling to hold him accountable is not just unpatriotic they are a witting accomplice.
