Court rules cigarettes can stay tax-free

For the moment, the state can't collect taxes on cigarettes American Indian vendors sell to non-Indians, a judge has ruled. But Gov. Eliot Spitzer indicated Monday his administration would be "moving forward" to resolve the matter.

Spitzer said he supports the law requiring tax collections.

Non-Indian convenience stores, which sell taxed cigarettes and want to force collections on Indian goods to level the playing field, said they were encouraged by Spitzer's words.
