Ann Beeson, who was Sibel Edmonds' ACLU lawyer speculated to this effect, since there is other more recent legislation that should supersede this privilege that is supposed to address secure evidence questions but has only been created for criminal cases. But that might not stop someone like Walton to make States Secret or some variant of this other law to somehow "dismiss" this case in a similar fashion, and the Supremes dismissing it the same way they did Sibel's case at the end of November and now Jeffrey Sterling's case today.
