There is always that option. I work in a pharmacy and we had this discussion the other day. The owner, a pharmacist basically said he would fill what perscriptions he wanted to. It was his business, if he lost business, so be it. But he would not be mandated to fill a script. Now, emergency contreception is not the only thing in question. Routinly, pharmacists refuse to fill perscriptions. It is not somthing that all of a sudden started happening. FYI that there are some catholic hospitals that do not stock BCP's in thier pharmacy for staff.

There is never be a law that says a pharmacit MUST fill ever prescription presented.
