But I agree that there appears to be an inequality of justice here. However, they seem to have the same attorney who himself said the cases are different, so perhaps it's not completely egregious.

Kind of an awkward spot for the attorney - it appears that the best argument in favor of one of his clients is that his other client got off too easily...
