Yes, benEzra is entirely correct: Asst. A-G Marchese should have said "You don't point a gun at someone and pull the trigger unless you fully intend to shoot him, and are prepared to face a charge of attempted murder, or worse."

There is a limited set of circumstances in which it is legally (and morally) permissible to point a gun at someone at pull the trigger, and that is while attempting to prevent that person from unlawfully inflicting death or permanent injury to yourself or others.
