About Proposition 8 in California

that would change the California Constitution to ban gay marriage:

Yesterday on CNN (cannot find the link) someone said that the California Supreme Court invalidated an earlier rule banning it based on the Federal Constitution assuring equal treatment under the law.

Thus, the commentator said, if 8 passes, it would remove rights from a group of people and wondered whether it would still stand.

Anyone knows anything?
