As confirmed in Kelo, cities' use of eminent domain for decades has been presumed to bear some "rational relation" to a broadly-defined "public use". They have no test to pass, but a holdout homeowner (such as a handful of the 115 families affected by the New Londodn development plan) DO have to pass a test to get their eminent domaion case into court. They must prove a negative--that there is NO RATIONAL BASIS for a sale forced by the city.
