I am not arguing because I see no point in doing so for the simple reason that you are correct, the current status of the filibuster is that it remains in the senate rule book (the little donkey in Horsey's cartoon is, as usual, accurately portrayed).

The current reality regarding it's use is that the next time a minority member attempts to do so, Frist will 'go nuclear' and he will have every member of the majority in a position of either supporting him or changing their party affiliation (those who did would be welcome under the RAP tent).

In my opinion, for the little that it is worth, I would have preferred that that happened before the 'extraordinary circumstance' caveat became attached because now, not only will Frist succeed in killing the filibuster, he will be in a position to blame it on the 'bad faith and bad behavior' of the minority -- which he is itching to do.

Beyond that, it doesn't matter. "America" is past tense, and it is time to focus on all that can be done to restore it; the dawning of the 2nd enlightenment is a nice way to envision the next several decades.
