And you are also correct that the Bush chosen court would be best (if it orders release of photos, which it may not). It's amazing how after Bush where we were all, "uh, Mr. Bush you aren't the only branch of government", but now with Obama, everyone wants him to ignore the role of Congress in creating the healthcare bill, and gets angry when things rightly end up at the USSC to be properly determined for posterity.
